QUESTÕES INERENTES AO TELETRABALHO EM SEDE DE NEGOCIAÇÃO COLETIVA: OS DESAFIOS E A RESPETIVA INTERVENÇÃO

Abstract

A presente investigação centra-se na intervenção e, consequentes, desafios com que a Negociação Coletiva se poderá deparar, enquanto protagonista do futuro da inovação num sistema de relações laborais, e alguns, até já observados na presente realidade, despoletando provocações para as relações de trabalho, em decorrência de uma diversidade de modalidades de organização do trabalho, mudanças nas estratégias de gestão empresarial e, claro, pelo recurso enérgico às tecnologias de informação e comunicação.Entendemos que o futuro do trabalho passará por estudar o futuro da Negociação Coletiva, pois não atentamos um cenário em que as inovações no trabalho podem não afetar a forma como são ordenadas pelos próprios protagonistas, e por entendermos que a sua intervenção poderá ser sublinhada na regulação específica do exercício de uma atividade em regime de Teletrabalho.O exposto pretende elucidar para os reptos surgidos ou, melhor, até ao momento invisíveis, e não perspetivados pelo legislador, quer português, quer espanhol, nem pelo diálogo social, procurando interpelar para questões que possam ser alvo de reflexão acerca da modalidade de trabalho que até então nos parecia distante.Com base nestas formulações, evidenciamos algumas temáticas que, no nosso entendimento, provocam maior indagação e, por isso, maior fragilidade na efetividade de determinados direitos dos trabalhadores pela falta de concretização e como a negociação coletiva poderá posicionar-se numa tentativa de progressão e evolução na regulação do Teletrabalho.

The present research focuses on the intervention and, consequently, challenges that Collective Bargaining may face, as a protagonist of the future of innovation in a system of labour relations, and some, even already observed in the present reality, triggering provocations for labour relations, as a result of a diversity of ways of organising work, changes in business management strategies and, of course, by the energetic use of information and communication technologies.We understand that the future of work will involve studying the future of Collective Bargaining, as we do not consider a scenario in which innovations in work may not affect the way they are ordered by the protagonists themselves, and because we understand that its intervention may be underlined in the specific regulation of the exercise of an activity in a Telework regime.This article aims to elucidate the challenges that have arisen, or rather, that have been invisible up to now, and which have not been envisaged by the Portuguese or Spanish legislator, or by social dialogue, to question the issues that may be the subject of reflection on this modality of work, which until then seemed distant to us.Based on these formulations, we highlight some issues that, in our understanding, cause greater questioning and, therefore, greater fragility in the effectiveness of certain rights of workers by the lack of concretization and how collective bargaining can position itself in an attempt to progression and evolution in the regulation of Telework.
