The present dissertation aims, in a coherent and structured way, to analyze the regime of pre-contractual litigation as it is currently shaped after the changes promoted by Law N.º 118/2019, of 09.17 and Law N.º 30/2021, of 05.21.As is well known, pre-contractual litigation is, in fact, very volatile and has been subject to several changes over the years. On the one hand, by virtue of European Law itself, and, on the other hand, by virtue of the transposition into national law and the difficulties felt in this legal adaptation. In order to fulfill this purpose, I will briefly address the beginnings of pre-contractual litigation until, finally, how it stands today.Initially, I will take in consideration the main interests associated with pre-contractual litigation as well as the legal figure initially present in the Portuguese Legal System, as a result of the initial Remedies DirectivesIn a second moment, I will explain the changes to the legal regime due to the transposition of Directive 2007/66/EC, through Decree-Law No. 214-G/2015, of October 2nd, which instituted changes that remain until today. In order to conclude, I will analyze in depth the new changes to the legal regime, with greater attention to the automatic suspensive effect in the action to challenge the adjudication acts.In the end, it will be possible to verify if these new changes brought any advantage to the regime as it was, as well as indicate some new ways of providing pre-contractual justice with better means to respond to the emerging disputes. |
