Resumo: Esta dissertação centra-se na análise dos novos desafios ao Direito da Família português, nomeadamente no que diz respeito às relações plurais amorosas e aos novos paradigmas do Direito da Filiação contemporâneo. Neste sentido, começa-se por abordar os moldes em que se encontra atualmente este ramo do direito, numa tentativa de encontrar um conceito de família consensual e adequado à modernidade e à pluralidade de arranjos familiares existentes. Numa segunda fase da dissertação, o estudo foca-se em algumas problemáticas que se poderão considerar novos e controversos desafios para o Direito da Família português. Primeiramente, aborda-se a questão das relações plurais amorosas como as uniões poligâmicas e as poliamorosas, apresentando-se argumentos e contra-argumentos à sua possível admissibilidade no nosso ordenamento jurídico. Realiza-se também uma análise aos aspetos jurídicos que compõem a sua proibição no direito português e uma possível abertura do nosso ordenamento jurídico em conceder alguns efeitos jurídicos a estas estruturas familiares. Por fim, explora-se os novos paradigmas do Direito da Filiação português assentes num possível enfraquecimento do princípio biologista e uma progressiva valorização do afeto e da vontade. Neste seguimento, analisa-se a temática da parentalidade socioafetiva tanto no nosso ordenamento jurídico como no ordenamento jurídico brasileiro, passando por temas como a multiparentalidade e as famílias recompostas; finalmente, versa-se também sobre a filiação estabelecida por meio das técnicas de procriação medicamente assistida. This dissertation focus on the analysis of the new challenges to portuguese Family Law, namely regarding plural loving relationships and the new paradigms of the contemporary Filiation Law. Thus, we begin by approaching the molds in which this branch of law is currently found, attempting to find a consensual concept of family suitable to the modernity and the plurality of the existing family arrangements. In a second stage of this dissertation, the study focuses on some issues that could be considered new and controversial challenges for the portuguese Family Law. Firstly, we address the question of plural loving relationships such as polygamous and polyamorous unions, presenting arguments and counter-arguments to its admissibility in our legal system. Furthermore, there is also an analysis of the legal aspects that compose its prohibition under the portuguese law as well as to the possible opening of our legal system in granting some legal effects to these family structures. Finally, we explore the new paradigms of portuguese Filiation Law, based on the possible weakening of the biological truth principle and the continuous valorization of affection and will. Therefore, we analyse the topic of socio-affective parenting, both in our legal system and in the Brazilian legal system, covering subjects such as multi-parenting and recomposed families; in the end, we discuss the establishment of filiation through Medically Assisted Reproduction techniques.
