A aplicação do RGEU aos projetos de reabilitação: análise crítica e propostas de adequação

Abstract

Face ao interesse do atual Governo português em criar condições para que a reabilitação seja a principal forma de intervenção ao nível do edificado e do desenvolvimento urbano, urge discutir, no âmbito deste trabalho, o âmbito e o teor da revisão do Regulamento Geral das Edificações Urbanas (RGEU), como passo imprescindível para viabilizar, efetivamente, a dinamização da reabilitação de edifícios em Portugal.Atualmente, o quadro regulamentar orientador da construção civil encontra-se voltado - quase na sua totalidade - para a construção nova; facto que deixa a reabilitação, praticamente, à margem do processo, seja em relação à omissão do regulamento a respeito deste domínio de intervenção, seja por este encontrar-se coberto por um regime de exceção. Nesse contexto, surge a inadiável tarefa de conferir à reabilitação um estatuto próprio, que seja capaz de promover a qualidade das intervenções, o respeito aos valores identificados e, nomeadamente, conferir orientações condizentes com a sua especificidade. Com este intuito, foi criado, pela Resolução do Conselho de Ministros n.º170/2017, o “Projeto Reabilitar como Regra”, cuja responsabilidade é, entre outras várias, elaborar propostas de adequação legal para os principais regulamentos da construção, em conformidade com as exigências e especificidades da reabilitação de edifícios, sem as quais se tornaria ilusória a concretização dos objetivos governamentais.Assim, pretende-se, no âmbito desta dissertação, proceder a um particular aprofundamento na análise do RGEU, não só por ser o regulamento mais antigo do quadro legislativo da construção em Portugal, mas também por representar a cúpula deste sistema regulamentar. Para tal, realiza-se um diagnóstico detalhado acerca do articulado atual e conclui-se pela efetividade da adequação proposta pelo “Projeto Reabilitar como Regra”, através de uma abordagem crítica acerca da pertinência do seu conteúdo.

In view of the interest of the current Portuguese Government in creating the conditions for rehabilitation to be the main form of intervention in terms of building and urban development, it is urgent to discuss the scope and content of the revision of the General Regulations on Urban Buildings (GRUB), as an essential step to make the rehabilitation of buildings indeed feasible, effective, and dynamic. Nowadays, the regulatory framework for civil construction is almost focused - in its entirety - on the new construction; which leaves the rehabilitation practically outside the scope of the procedure, either in relation to the omission of the regulation in respect of this policy area; or because it is currently covered by an exception regime.In this context, there is the urgent task of providing rehabilitation with its own statute, which is capable to promote the quality of interventions, to respect the appropriate values and, above all, to give better guidelines according to their own specificity. To this end, the Project "Reabilitar como Regra” was created by the Resolution of the Council of Ministers n.º 170/2017 to propose the legal adequacy for the main construction regulations in accordance with the requirements and specificities of the rehabilitation of buildings, without which the achievement of governmental objectives would be illusory. Therefore, it is intended, in the scope of this dissertation, to proceed a particular and profound analysis of GRUB, not only because it is the oldest regulation of the legislative framework of construction in Portugal, but also because it represents the top of this regulatory system. To this end, a detailed diagnosis is made of the current articulation and it is concluded by the effectiveness of the adequacy proposed by the Project “Reabilitar como Regra", through a critical approach on the pertinence of its content.
