Mas, nem todas as relações jurídicas do falecido se extinguem pela morte deste, sendo necessário substituir o de cuius nessas relações. Para tal, abre-se a sucessão mortis causa, que se trata do chamamento de uma ou mais pessoas à titularidade das relações jurídicas patrimoniais do de cuius e a consequente devolução dos bens que lhe pertenciam (art. 2024º do Código Civil). Existem dois tipos de sucessão quanto à fonte: a legal e a voluntária. Neste trabalho, irá dar-se importância à sucessão voluntária e, dentro desta, à sucessão testamentária e ao testamento. O artigo 2179º do Código Civil define o testamento como o ato unilateral e revogável pelo qual uma pessoa dispõe, para depois da sua morte, de todos os seus bens ou de parte deles. Para além do seu conceito e natureza, também serão desenvolvidas matérias relacionadas com o testamento: a capacidade testamentária, a divergência entre a vontade e a declaração, os vícios da vontade, a interpretação do testamento, a integração do testamento e o conteúdo do testamento.O principal foco deste trabalho será a interpretação do testamento, mas não será o único.A personalidade jurídica de uma pessoa extingue-se com a morte (art. 68º, nº 1 do Código Civil). To do that, the inheritance is open, which is the devolution of property on an heir or heirs upon the death of the owner (art. 2024º, Civil Code). There are two types of succession: intestate succession and testate succession. Art. 2179º, Civil Code, determine will as a unilateral and revocable act made by a person to dispose all his rights and properties or some of them, after his death. This paper focus on the will’s definition and its nature, but also in other relevant themes: testamentary capacity, divergence between will and declaration, vices, will’s interpretation, will’s integration and content of the will.
