A representatividade no pluralismo e na unicidade sindical

Abstract

O presente estudo tem como objetivo analisar a representatividade sindical tanto no pluralismo, onde tende a despontar com veemência em razão dos sindicatos concorrentes, quanto na unicidade onde assume caráter estreito por força dos sindicatos únicos. Para tanto o primeiro momento é dedicado à compreensão dos possíveis regimes sindicais desde as suas origens até as acepções normativas e controvérsias colocadas em cada âmbito. Ao adentrar no cerne do objeto, a partir do segundo momento, procuramos estabelecer aproximações cognoscíveis entre a representatividade e a unicidade sindical, nomeadamente à luz do sindicalismo brasileiro que apresenta uma estrutura peculiar a propósito do monopólio sindical imposto por lei. No terceiro momento, ao alcançarmos o pluralismo sindical, começamos por analisar a representatividade a partir de seu excurso histórico até os delineamentos conferidos no âmbito da Organização Internacional do Trabalho e da União Europeia. Adiante perquirimos exemplos de ordenamentos jurídicos com o intuito de demonstrar o desenvolvimento e o quadro normativo da representatividade num cenário onde se encontra regulada por critérios objetivos. Frente a esse conjunto de abordagens, nos conduzimos ao cenário português para analisar a realidade do pluralismo sindical desprovido de critérios de representatividade sindical, embora algumas manifestações estejam presentes no ordenamento jurídico. Em síntese, nos propomos a corrente análise para tentar demonstrar a relevância do instituto nas estruturas sindicais como ferramenta de segurança para a efetiva representação dos trabalhadores sobretudo num cenário de profundas transformações nas organizações laborais.

The present study aims at analyze union representativeness both in pluralism, where it tends to emerge strongly due to competing unions, and the unicity where it assumes a narrow character through the unique unions. For that, the first moment is dedicated to the understanding of the possible union regimes from their origins to the normative and controversial meanings placed in each scope. When entering the core of the object, from the second moment, we try to establish knowable approximations between the representativeness and union unity, in particular in the light of brazilian syndicalism that presents a peculiar structure regarding the unique union imposed by law. In the third moment, when we achieve trade union pluralism, we begin by analyzing representativeness from its historical background to the designs that are reserved to it within the framework of the International Labour Organization and the European Union. Ahead we analyze examples of legal systems in order to demonstrate the development and normative framework of representativeness in a scenario where it is regulated by objective criteria. In view of this set of approaches, we are led to the national scenario to analyze the reality of union pluralism devoid of criteria of union representation, although some manifestations are presents in the legal system. We propose the current analysis to try to demonstrate the relevance of the institute in the union structures as a security tool for the effective representation of the workers, especially in a scenario of profound transformations in the labour organizations.
