Não raras vezes, tais valores e princípios são conflituantes, situação que impõe uma tarefa de compatibilização de acordo com os interesses em causa. Oscilando a sucessão legitimária entre valores antinómicos, como o da liberdade de testar e o da proteção da família nuclear, nem sempre é fácil encontrar um justo equilíbrio quando se sobreponham. Porque o legislador continua a privilegiar a proteção da família nuclear em detrimento da liberdade de testar, não obstante as mudanças ocorridas, tanto no seio familiar como na mentalidade dos indivíduos, o Direito das Sucessões atravessa uma “crise” que se vem refletindo, entre outras coisas, na utilização de instrumentos alternativos ao testamento como forma de alargar aquela liberdade e dar cumprimento à vontade do autor da sucessão. Sometimes those principles and values come into conflict, such a situation imposes a task of compatibilization in accordance with the interests at stake. Oscillating the reserved portion of estate between opposing values such as testamentary freedom and protection of nuclear family, is not always easy to find a fair equilibrium when they superimpose each other. Because the lawmaker continues to benefit the protection of nuclear family in lieu of testamentary freedom, irrespective of the changes in the family core and the mentality of the individuals, the law of succession is going through a crisis that has reflected on, among others, the usage of alternative instruments to testament as a way to widen the freedom of the tester.
