Mas, não iremos adotar a posição deste ou daquele autor que defende uma única natureza para esta figura, pelo contrário, demonstraremos as diferentes opiniões (há quem defenda se tratar de um assistente, há quem diga que ele é sim um “amigo da corte”, ou seja, um simples auxiliar do juízo, há ainda os que dizem se tratar de uma intervenção de terceiros ou de um fiscal da lei – “custos legis”), e sustentaremos que todos podem estar corretos. Sim, ao longo do nosso trabalho defenderemos a ideia de que dependendo da forma como o “amicus” ingressa no processo (voluntariamente ou a requerimento das partes), sua natureza jurídica poderá se modificar dentre todas essas opções já citadas. Para contextualizar nossa pesquisa faremos uma breve passagem pela história do “amicus” e de sua importância no Processo Civil Cooperativo.
