Desculpar o Indesculpável em situações-limite : reflexões sobre a tortura em casos de bomba-relógio

Abstract

Profundamente enraizado em causas de justificação, o debate atual sobre a tortura sugere que tal prática poderá ser reputada como lícita em casos de bomba-relógio. Reconhecendo a importância na manutenção da sua ilicitude, cremos que o tema poderá ser observado à luz das causas de desculpa, concentrando-nos nas motivações do agente. Esta perspectiva permite a edificação de uma parede protetora do agente, tornando-o imune à punição, enquanto se mantém a natureza ilícita do facto. Contudo, a principal questão desvia-se ligeiramente destas observações: devemos mesmo desculpar este crime bárbaro, e permitir um slippery slope? A Tortura nunca será o mal menor, e a sua erradicação deverá ser a prioridade nas sociedades modernas. ABSTRACT Deeply rooted on justification defenses, the current torture debate hints at the idea that this practice could be regarded as lawful in ticking-time bomb scenarios. Recognizing the importance of keeping its unlawfulness, we believe that we could contemplate this topic under the spotlight of excuses, focusing on the motivations of its agent. This perspective allows the edification of a wall surrounding the agent, making him immune to punishment, while keeping the criminal nature of the act. However, the main question departs slightly from these observations: should we even excuse this barbaric crime, and allow a slippery slope to take place? Torture will never be the lesser evil, and preventing it should be the main goal of modern societies
