Resumo: A presente investigação centra-se no estudo do tema da invalidade parcial do contrato individual de trabalho, e pretende traçar os contornos do regime de invalidade parcial do contrato de trabalho no direito português, tomando como eixos ou coordenadas estruturantes duas questões que transportam uma certa ambiguidade e que conferem ao tema, ao arrepio do que vem sendo comummente veiculado nos ensinamentos doutrinais nacionais e de direito comparado, um carácter problematizador. Num primeiro nível, e uma vez que o sistema jurídico laboral intervem, amiúde, impondo a manutenção coactiva do contrato de trabalho, a questão do enquadramento dogmático e do(s) fundamento(s) que estão por detrás das técnicas de conservação coactiva. Num segundo plano, a questão da aplicabilidade do regime de redução comum ao contrato de trabalho (artigo 292.º do Código Civil), desde logo, a questão do próprio Se da aplicação do referido regime ao contrato de trabalho – sabendo-se da tensão existente entre uma possível destruição do vínculo laboral fruto da aplicação do referido regime e a tutela jurídica do bem emprego – assim como do Critério orientador que, em caso afirmativo, permite distinguir as hipóteses que caem sob a alçada do regime jurídico comum da redução daquelas outras que obedecerão a soluções de conservação obrigatória. Reflectir sobre estas, entre outras questões, concitará a análise do ordenamento jus-laboral, mas, igualmente, desde o início, o apelo ao direito civil, atentas as numerosas figuras civilísticas que serão mobilizadas e que a compreensão do tema pressupõe. Procede-se a uma divisão entre hipóteses de não aplicação do regime comum da redução – contexto onde são analisadas as diferentes técnicas através das quais o sistema jurídico intervém, assegurando a conservação do contrato de trabalho, por vezes, com expressa consagração no direito positivo, outras vezes, fruto de criação doutrinal e/ou jurisprudencial – e hipóteses de aplicação do regime comum da redução. No primeiro grupo, destaca-se a solução contida na parte geral do Código do Trabalho – o artigo 121.º, n.º 2 – a qual, ao cominar o efeito conservador-substitutivo em termos omnicompreensivos e tentaculares, suscita, sobretudo desde 2003, sérias dificuldades quanto à sua fundamentação. Por isso, expõem-se algumas das possíveis linhas de fundamentação, tendo em vista um debate que ainda não foi feito na doutrina nacional. Também é dado relevo à problemática da conservação do contrato assegurada através de uma actividade integrativa do regulamento contratual a realizar pelo juiz, à aplicação do regime jurídico de invalidade parcial do contrato de adesão ao contrato de trabalho, e à resposta do sistema a eventuais situações-limite em que o efeito de conservação do contrato de trabalho provoca uma turbação significativa no equilíbrio entre as prestações das partes. Ao lado das soluções de conservação coactiva, é possível formular hipóteses de invalidade parcial do contrato de trabalho em que a aplicação do regime comum da redução cobra sentido. Parece de afastar, com efeito, uma análise que postule a absoluta incompatibilidade entre os dois elementos da “equação”, conquanto se reconheça a pouca pertinência da reprodução de uma regra como essa na lei laboral. São ainda discutidos os possíveis critérios orientadores na identificação do tipo de regime jurídico de invalidade parcial aplicável, estando a complexidade da questão, acredita-se, actualmente relacionada com as dificuldades registadas ao nível da fundamentação das soluções de conservação autoritária.
The present research focuses on the study of the topic of partial invalidity of the individual employment contract, and intends to draw the outlines of the regulation of partial invalidity of the employment contract in Portuguese Law, taking as axes or structuring coordinates two questions, which carry a certain ambiguity in themselves, and confer a problem-creating character to the issue of partial invalidity, in an opposite direction to that which is commonly transmitted by the teachings of national and comparative law. On a first level, and due to the fact that the employment legal system frequently intervenes by imposing the coercive preservation of an employment contract, the question of the dogmatic framework and that of the underlying grounds of the technical solutions of coercive preservation. On a second plane, the question of the applicability of the common reduction system to the employment contract, from the outset, the question of the If itself of the application of the aforesaid system to employment contracts – the existence of tension between the possible destruction of the bond as a result of the application of the abovementioned regulation, and the protection of the legally protected interest of employment being known – as well as of the guiding Criterion which, in an affirmative case, makes it possible to distinguish the hypotheses which fall under the common legal system of reduction, from those which shall correspond to solutions of coercive preservation. Reflecting on these and other questions will spark the analysis of the legal order, but at the same time call upon civil law, given the numerous civil-figure categories which will be mobilized, and that the comprehension of the topic presupposes. We proceed to a division between hypotheses of non-application of the common reduction system – context in which the different techniques through which the legal system intervenes are analysed, ensuring the preservation of the employment contract, sometimes expressly adopted in positive law, others, the result of doctrine and/or jurisprudence – and the hypotheses of application of the common reduction system. In the first group, the solution provided for in the general part of the Labour Code – section 121th, no. 2 – stands out, which generates serious difficulties regarding its grounds, when it threatens the preservation-substitution effect in all-encompassing and tentacular terms. That is why some of the possible motivation lines are introduced, keeping in sight a debate that has yet to take place in national doctrine. Importance is given, as well, to the problem of preservation of the contract, ensured by means of the integrative activity of contractual regulation to be carried out by the judge, to the application of the legal system of partial invalidity of the adhesion contract to the employment contract, and to the response of the system to occasional limit situations in which the effect of the preservation of the employment contract generates a significant disturbance to the balance of the parties’ obligations. Next to the solutions of coercive preservation, it is possible to formulate hypotheses of partial invalidity of the employment contract, where the application of the common reduction system makes sense. In effect, it would seem that an analysis which establishes the absolute incompatibility between the two elements of the “equation” should be set aside, notwithstanding the recognition of the little pertinence of the reproduction of a rule such as the aforementioned in Employment Law. Furthermore, the possible orientation criteria for the identification of the applicable type of legal system of partial invalidity are under discussion, with the complexity of the question believed to be currently related to the difficulties generated at the level of the grounds for the solutions of authoritarian preservation.
