As Quotas de Género na Participação Política

Abstract

A posição das mulheres na sociedade, tradicionalmente resumida ao cuidado do lar e dos filhos, viu uma evolução significativa, que lhes abriu as portas do ensino e do mercado de trabalho e fez possível a sua presença ativa na vida pública. Ainda assim, a discriminação que sofrem, fundada nos preconceitos que, daqueles tempos, subsistem, mancha o seu percurso e afeta as suas oportunidades, o que é especialmente percetível ao verificar a sua sub-representação em órgãos do poder político e do poder económico. Impunha-se, portanto, uma solução e a discriminação positiva, na forma de quotas de género, ofereceu uma via rápida para o aumento da participação política das mulheres, que serve de objeto ao presente estudo. Através dele, reunindo um conjunto de bibliografia, relatórios e jurisprudência sobre o tema, pretende-se entender as questões jurídicas e políticas suscitadas pelas quotas de género, nomeadamente a sua complexa relação com os princípios tradicionais da igualdade e da não discriminação, assim como o seu envolvimento com o (mais recente) conceito de paridade, e analisar as várias formas que assumem, confrontando as críticas que lhes são endereçadas com os seus resultados numéricos e substantivos. Desta forma, tomando em consideração as opções do legislador português, a par das soluções encontradas no direito comparado neste domínio, este estudo procura compreender o atual significado das quotas de género e averiguar a sua eventual contribuição para uma transformação mais profunda.

Women’s position in society, traditionally summarized in the care of the home and the children, has seen a significant evolution that opened them the doors to education and the job market and made their active presence in public life possible. Still, the discrimination women suffer, founded on the prejudice that subsists from that time, stains their path, and affects their opportunities, which is especially noticeable seeing their under-representation in bodies of the political power and the economic power. Therefore, a solution was required and positive discrimination, in the form of gender quotas, offered a fast-track to the rise of women’s political participation, which serves as the object of the present study. Through it, gathering a set of bibliography, reports, and case-law about this subject, it is intended to understand the legal and political questions raised by gender quotas in political participation, namely their complex relationship with the traditional principles of equality and non-discrimination, as well as their involvement with the (more recent) concept of parity, and to analyze the various forms they take, confronting the criticism addressed to them with their numerical and substantive results. This way, considering the options of the Portuguese legislator, alongside the solutions found in comparative law in this domain, this study seeks to comprehend the current meaning of gender quotas and to ascertain their possible contribution to a deeper transformation.
