Abstract: A presente dissertação ocupa-se do problema da repartição de funções entre Administração e Juiz na execução da pena privativa da liberdade. Tem como objectivo averiguar da existência de esferas de “reserva” de competência, quer do Juiz, quer da Administração, na fase da execução da pena, constitucionalmente impostas, e estabelecer critérios para a definição do domínio funcional de cada um daqueles órgãos intervenientes na execução. Pretende igualmente apurar, a partir do direito constitucional e do direito internacional, as exigências de tutela jurisdicional efectiva dos cidadãos privados da liberdade e questionar se a singularidade do universo penitenciário justifica características específicas da tutela a oferecer àqueles. Os critérios apurados servirão de parâmetro a uma análise crítica do ordenamento português relativo à execução da pena de prisão. À luz dessa análise, e colhendo inspiração em outros lugares do ordenamento jurídico português, bem como em exemplos do direito comparado, procura-se dar um contributo para um modelo de repartição de funções e de tutela jurisdicional em conformidade com as exigências constitucionais e jurídico-internacionais. O estudo é organizado em cinco Partes. A Parte I constitui uma aproximação histórico-constitucional e doutrinal ao princípio da separação dos poderes e à caracterização das funções jurisdicional e administrativa, incluindo à questão da existência de esferas de “reserva” do Juiz e da Administração e do seu eventual conteúdo. Debruça-se igualmente sobre as exigências decorrentes do direito fundamental dos cidadãos a uma tutela jurisdicional efectiva perante actuações da Administração e perante decisões judiciais. O objectivo é delinear o quadro constitucional e jus-internacional que deverá orientar a posterior tarefa de determinação das funções da Administração e dos Tribunais na execução da pena de prisão. Na Parte II, trata-se de aplicar os critérios encontrados na Parte I ao domínio da execução da pena de prisão. Está em causa, sobretudo, averiguar se – e em que medida – as especificidades do universo prisional devem ter repercussões na definição do domínio funcional dos Tribunais e da Administração e nas exigências de tutela jurisdicional. Procura-se então delimitar os domínios funcionais da Administração e do Juiz na execução, bem como os seus domínios nucleares, em conexão com as respectivas responsabilidades. Tomam-se em conta os desenvolvimentos recentes no quadro jurídico europeu, particularmente por via da jurisprudência do Tribunal Europeu dos Direitos do Homem e do Tribunal de Justiça da União Europeia, que vêm reforçar as exigências de efectividade da tutela oferecida às pessoas privadas da liberdade e que deverão influenciar a evolução próxima dos ordenamentos penitenciários europeus, incluindo o português. Os critérios encontrados servirão de parâmetro para a apreciação do quadro jurídico português vigente. Na Parte III, analisa-se o ordenamento jurídico português, na sua evolução histórica, desde a generalização da pena de prisão como forma dominante de punição dos crimes e, sobretudo, desde a criação dos tribunais de execução das penas. Examina- -se a evolução doutrinal, legislativa e jurisprudencial, na matéria que releva para o tema do presente trabalho, com vista a uma apreciação crítica à luz dos parâmetros identificados nas duas Partes precedentes. Resultando dessa apreciação a necessidade de superar insuficiências que impedem a plena conformidade do ordenamento jurídico português às exigências de direito constitucional e internacional, a busca de soluções não prescinde de uma investigação das soluções adoptadas em ordenamentos jurídicos vinculados por tradições constitucionais comuns e pelos mesmos instrumentos internacionais de direitos humanos. Assim, na Parte IV, examina-se o modo como, em outros ordenamentos jurídicos, especialmente europeus, se resolve a questão da repartição de funções entre Administração e Juiz na execução da pena e se assegura a tutela jurisdicional efectiva dos direitos das pessoas privadas da liberdade. A Parte V conclui a investigação com a elaboração de soluções para uma evolução do direito português, em sentido que assegure uma repartição de funções na execução da pena que, simultaneamente, se coadune com o esquema constitucional de organização dos poderes e, dentro dos limites por este definidos, prossiga o mais eficientemente possível as finalidades da execução e a tutela dos direitos das pessoas privadas da liberdade. Pretende-se, deste modo, oferecer um contributo para um modelo de repartição de funções entre Administração e Tribunais na execução da pena privativa da liberdade conforme à Constituição e ao direito internacional.
This dissertation deals with the problem of the distribution of functions between the Prison Administration and the Courts in the implementation of prison sentences. The aim of the thesis is to determine the criteria that should govern the definition of the role of both administrative and judicial bodies in the penitentiary system, as well as the scope and limits of their intervention. It also seeks to ascertain the requirements imposed by constitutional and international law regarding the effective judicial protection of citizens deprived of their liberty, questioning whether the singularities of the prison justify any deviation to the general model of judicial control of administrative action. The research aims to provide criteria which comply with the constitutional scheme of distribution of powers, ensure an effective judicial protection of prisoners' rights and allow for the best possible achievement of the purposes of imprisonment. The criteria obtained will serve as a parameter for a critical analysis of the Portuguese penitentiary system. In the light of this analysis, and drawing inspiration from a comparative study of the issue in several other countries, the thesis aims to provide a contribution to a model of distribution of functions and judicial protection that fully complies with the Constitution and the requirements of international law. The research is structured in five parts. Part I offers a historical, constitutional and doctrinal perspective of the principle of the separation of powers and the definition of the judicial and administrative functions in the Portuguese Constitution. It also deals with the requirements arising from the fundamental right of citizens to an effective judicial protection. The aim is to outline the constitutional and international law framework that should guide the subsequent task of determining the functions of the Administration and the Courts in the implementation of the prison sentence. Part II seeks to apply the criteria found in Part I to the domain of the implementation of the prison sentence. It is mainly a question of ascertaining whether – and to what extent – the specific features of the prison world justify any deviation to the general roles of the Courts and the Administration or to the general requirements of judicial protection of citizens. Account is taken of recent developments in the European legal framework, particularly through the case law of the European Court of Human Rights and the Court of Justice of the European Union, which have recently strengthened the requirements for the effectiveness of the protection offered to persons deprived of their liberty. The guidelines obtained therefrom will serve as a parameter for a critical assessment of the current Portuguese legal framework. Part III analyses the Portuguese penitentiary system in its historical evolution, particularly since the creation of the courts for the execution of sentences. Legislative, jurisprudential and doctrinal developments are examined, regarding the topic of the roles of the Courts and the Administration, with a view to a critical assessment in the light of the parameters identified in Parts I and II. The assessment will show that there are still shortcomings that prevent the Portuguese legal system from fully complying with the requirements of constitutional and international law, especially in what concerns the obligation to provide an effective judicial protection. In order to search for solutions to overcome those shortcomings, Part IV will examine how, in other legal systems, especially European, the question of the distribution of functions between the Administration and the Judge in the execution of the sentence is resolved and the effective judicial protection of the rights of persons deprived of their liberty is ensured. Finally, Part V seeks to propose solutions for the improvement of the Portuguese legal system in order to ensure that the distribution of functions in the execution of the custodial sentence is in line with the constitutional scheme of organization of powers and, within those limits, pursues the purposes of imprisonment as efficiently as possible and optimizes the judicial protection of the rights of persons deprived of their liberty.
