dc.description.abstract | Com os mercados cada vez mais competitivos e exigentes, os Estados tiveram a necessidade de se adaptar e criar sistemas fiscais que os tornassem mais atrativos aos sujeitos não residentes no seu território.O presente estudo propõe-se a analisar o regime fiscal que foi introduzido no ordenamento jurídico português, em 2009, pelo DL n.º 249/2009 de 23 de Setembro: o Regime do Residente Não Habitual, que apresentava uma taxa de tributação reduzida para quem dele beneficiasse. Pretende-se compreender as fragilidades do regime e a sua aplicabilidade, bem como fazer o confronto com regimes fiscais de outros países que, como ele, tinham como finalidade a atração de sujeitos passivos residentes no estrangeiro.É realizada uma abordagem quanto à relevância do critério da residência no Direito Tributário, sendo este o primeiro requisito para aplicação do regime, e os seus âmbitos de aplicação, bem como aos seus princípios orientadores. Após esta primeira abordagem, fundamental para a análise de todo o regime dos residentes não habituais, será feita a análise do acesso ao regime e da tributação que este prevê, discriminando entre os rendimentos obtidos dentro e fora de Portugal.Como este é um regime que tem na sua origem a competitividade no âmbito das relações internacionais, principalmente dentro da União Europeia, é fundamental fazer uma análise do regime e das consequências que este pode trazer quando aplicado, bem como analisar a sua admissibilidade à luz do direito europeu e a sua comparação com alguns regimes adotados por países da UE que pretendem alcançar o mesmo objetivo.A nível de direito interno, cabe aferir a natureza jurídica do regime e fazer um confronto do regime com os princípios constitucionalmente tutelados.No fundo, pretende-se avaliar o impacto do Regime do Residente Não Habitual e apreciar a sua legalidade e conformidade com o direito interno e o direito comunitário. | por |
dc.description.abstract | With more competitive and demanding markets, States had the need to adapt and create tax systems that would make them more attractive to individuals who do not reside in their territory.This study aims to analyze the tax regime that was introduced in the Portuguese legal system in 2009 by Decree-Law No. 249/2009 on September 23rd: the Non-Habitual Resident Regime, which presented a reduced tax rate for those who benefited from it. It is intended to understand the weaknesses of the regime and its applicability, as well as to make the comparison with tax regimes of other countries that had the purpose of attracting taxable persons residing abroad, as well.An approach is made regarding the relevance of the residence criterion in Tax Law, this being the first requirement for the application of the regime, and it’s scope of application, as well as its guiding principles. After this first approach, fundamental for the analysis of the entire regime for non-habitual residents, the analysis of access to the regime and the taxation it provides will be carried out, discriminating between income obtained within and outside Portugal.As this is a regime that has its origins in competitiveness in international relations, especially within the European Union, it is essential to analyze the regime and the consequences that it can bring when applied, as well as analyze its admissibility in light of the European law and its comparison with some regimes adopted by EU countries that intend to achieve the same purpose.At domestic’s law level, it is necessary to assess the legal nature of the regime and compare it with the constitutionally protected principles.Basically, the aim is to assess the impact of the Non-Habitual Resident Regime and assess it’s legality and compliance with domestic and community law. | eng |
