dc.description.abstract | A presente investigação centra-se na análise do artigo 103.º, n.º 1, alínea c) do Regime Geral das Infrações Tributárias, sendo esta alínea uma das condutas ilegítimas previstas pelo crime da fraude fiscal. Analisa-se a evidente conexão existente entre o Direito Fiscal e o Direito Penal, uma vez que revestem particular importância as ligações entre estes dois domínios, enquanto vetores primários dos direitos fundamentais que hoje consubstanciam um Estado de Direito Moderno, dada a relevância do fenómeno tributário na nossa sociedade. Faz-se uma análise de todos os conceitos inerentes à simulação, nomeadamente as características próprias da simulação civil e, com base nessa, e noutras considerações, como se constrói o conceito da simulação fiscal, assim como esta se manifesta na legislação tributária.Com base nestas formulações, faz-se uma breve exposição dos princípios que modelam a intervenção penal geral. Com base na alteração social que temos assistido na comunidade ao longo dos últimos tempos, torna-se essencial falar do movimento da eticização do direito penal fiscal. Assim, e por último, considerando todas as ilações passíveis de serem retiradas ao longo da investigação, procedemos à análise do conceito da simulação fiscal enquadrada no crime de fraude fiscal, assim como este é, e deve ser, claramente distinguido e não mesclado com o conceito autónomo da simulação fiscal. dc.description.abstract | The present investigation focuses on the analysis of the article 103, paragraph 1, point c) of the General Regime of Tax Infractions, this point being one of the illegitimate conducts foreseen by the crime of tax fraud.The evident connection between Tax Law and Criminal Law is analysed, since the links between these two domains are of particular importance, as primary vectors of fundamental rights that today constitute a Modern Rule of Law, given the relevance of the tax phenomenon in our society.An analysis is made of all the concepts inherent to the simulation, namely the characteristics of the civil simulation and, based on this, and on other considerations, how the concept of the fiscal simulation is constructed, as well as this is manifested in the tax legislation.Based on these formulations, a brief presentation is made of the principles that shape general criminal intervention. Based on the social change that we have seen in the community over the last few years, it is essential to speak about the movement for the ethicization of criminal tax law.Thus, and lastly, considering all the lessons that can be learned in the course of the investigation, we proceed to the analysis of the concept of tax simulation framed in the crime of tax fraud, as it is, and must be, clearly distinguished and not mixed with the autonomous concept of fiscal simulation.
