Inteligência Artificial: Personalidade e Responsabilidade Civil

Abstract

Mas serão as tecnologias incorporadas com sistemas inteligentes, instrumentos mais duvido-sos que outros, concebidos pelo ser humano ao longo destes últimos séculos? O domínio e intensificação da Inteligência Artificial (IA) é, para já, um assunto que não dispensa apresentações. Concomitantemente ao seu imenso e espantoso crescimento não se prescindirá de exigências correspondentes, simétricas, harmoniosas e niveladas com os princípios fundamentais e, que o Direito não poderá omitir. Independentemente da área de atuação, ser de biotecnologia ou não, a IA está cada vez mais próxima do nosso quotidiano e, caso ela ainda não se tenha tornado parte da nossa rotina ou da nossa empresa, ela com certe-za vai encontrar uma oportunidade para interferir direta ou indiretamente no nosso espaço de ação. Dadas as circunstâncias, não será de estranhar, que este cenário, a se confirmar, poderá configurar um risco iminente de grandes transformações, com incidência óbvia no desenvol-vimento natural da nossa realidade civizacional e por questões intrínsecas, interferir dramati-camente no sistema jurídico vigente. O hiato entre o pensamento do ser humano e a dedução lógica das máquinas foi excessivamente encurtado pela intervenção recente da IA. As suas características tecnológicas são infinitas e de elevada complexidade que carecem urgente-mente por parte de todos nós, mais atenção e disponibilidade. O presente estudo, vem, em auxílio de uma explicação para uma razoabilidade tácita e eticamente estimada entre o dualismo “homem versus máquina” que para tal, lança alguns quesitos arrolados com a personalidade jurídica e responsabilidade civil, como possíveis fa-tores (des)equilibradores desta futura e mais que provável aliança. Somos, por isso, idealistas de determinadas posições e plenamente cientes que as soluções a revelar sejam verdadeiros aditamentos às melhorias e reforços oportunos à efeti-vação da IA.Palavras chave: Inteligência Artificial; Personalidade Jurídica; Responsabilidade Civil; E-persons e Ética.

Are embedded intelligent systems more dangerous than any other instrument designed by man in the last centuries? For now, the dominance and intensification of Artificial Intelligence (AI) still require an introduction. While AI grows hugely and amazingly, corresponding, symmetrical, and harmonious requirements, which are aligned with the fundamental rights and cannot be over-looked by the Law, cannot be waived. Irrespective of whether the area of operation is technological, AI is closer and closer to our daily lives. Even if it has not yet become part of our routine or our company’s routine, AI will surely find an opportunity to step in directly or indirectly. Given the circumstances, if this scenario comes true, it will not be surprising that it will bring the imminent risk of great transformations that will affect the natural development of our civilizational reality and, con-sequently, for intrinsic aspects, interfere with the legal system in force. The gap between hu-man thinking and the logical reasoning of machines was hugely reduced by the recent inter-vention of AI. Its capacities are overly complex matters that are in urgent need of more atten-tion and intellectual availability from society’s players. This study aims to contribute to an answer that pursues a tacit, ethically accepted rea-sonability of the duality “man versus machine”. To that end, some concerns about legal per-sonality and civil liability are debated as potential (un)balancing factors to this future, almost certain alliance. We stand by certain positions and believe that the solutions to reveal will contribute to improving and reinforcing reasonably the establishing of AI.Keywords: Artificial Intelligence; Legal Personality; Civil Responsibility; E-persons and Ethics.
