Abstract: O alvor do séc. XXI colocou na ribalta do debate administrativista europeu a Regulação Pública. Pesem embora os antepassados remotos do instituto, foi apenas na sequência das mutações sociopolíticas do final do século passado que os Estados europeus se assumiram verdadeiramente como Estados Reguladores. Apesar da propensão inicial espontânea para importar o modelo estadunidense, ao qual se reconhece um grau de maturidade que permite a respetiva elevação a paradigma, tornou-se clara a imperatividade de realização de um ajustamento que permitisse honrar o “modelo social europeu”. A discussão em torno do “novo” papel do Estado toca intimamente a identidade europeia, mormente no que diz respeito à tradição socializante e à proteção dos direitos económicos, sociais e culturais dos cidadãos. No contexto regulatório brotam relações de configuração triangular, em que o Estado se vê colocado na posição de garante. Enquanto tal, compete-lhe tutelar as posições jurídico-subjetivas dos particulares, máxime as que resultam extraídas da sua condição de titulares de direitos fundamentais. Equaciona-se, então, até onde deve ir a responsabilidade pública de garantia e pondera-se a respetiva justiciabilidade. O direito subjetivo à regulação surge, neste cenário, como uma manifestação da subsistência do comprometimento estadual com o princípio da socialidade. Os tempos são de adaptação e, por isso, também a dogmática deve ajustar os seus institutos tradicionais. A operatividade dos modelos jurídico-políticos depende da efetividade real dos seus alicerces teóricos na perspetiva dos destinatários – assim, o modelo regulatório e a responsabilidade pública de garantia que o sustenta pressupõem a consagração de um poder jurídico correspondente na esfera dos cidadãos.
The dawn of the 21st century has put Public Regulation in the spotlight of European’s administrative debate. Despite the institute's remote roots, it was only as a result of the socio-political changes of the end of the last century that European States truly assumed themselves as Regulatory States. Although the initial spontaneous tendency was to import the U.S. model, whose recognized maturity makes it the paradigmatic model, it became clear that it was imperative to make an adjustment that would honor the "European Social Model". The discussion on the “new” role of the State is closely related to the European identity, especially regarding the socializing tradition and the protection of citizens' economic, social and cultural rights. In the regulatory context, relations of triangular configuration sprout, in which the State is placed in the position of guarantor. As such, it is public responsibility to protect the subjective positions of individuals, above all those extracted from their status as holders of fundamental rights. We must consider how far the public responsibility should go and consider its justiciability. The idea of a right to regulation arises, in this scenario, as a manifestation of the subsistence of the State commitment to the principle of sociality. Times are of adaptation and therefore dogmatic must also adjust her traditional institutes. The operability of legal-political models depends on the real effectiveness of their theoretical foundations from the perspective of the recipients - thus, the regulatory model and the public responsibility of guarantee require the consecration of a corresponding legal power in the sphere of citizens.
