This dissertation deals with the problem of recognizing legal personality to artificial intelligence entities from an ethical and legal point of view.It is beyond doubt that the human being, as a person, has legal personality; however, the question arises about the possibility of extending legal personality to new autonomous and self-learning robots. To analyse the question we will try to understand who is the human person that founds, with his dignity, the juridical order, and why it is not possible not to recognize legal personality to any person, so that, in a second step, and being conscious that the legal system also allows the extension of legal personality to juridical persons, we can understand if a functionalist perspective can explain the attribution of legal personality to robots. This analysis cannot ignore the dominant value and cultural options, as well as an axiological presupposition that makes the legal system a true Order of Law.This dissertation deals with the problem of recognizing legal personality to artificial intelligence entities from an ethical and legal point of view.It is beyond doubt that the human being, as a person, has legal personality; however, the question arises about the possibility of extending legal personality to new autonomous and self-learning robots.
