O problema jurídico da governabilidade em sistemas presidencialistas - perspectivas e desafios à luz do estado democrático de direito

Abstract

A princípio, esta dissertação enfrenta o desafio de expor as dimensões e acepções do termo governabilidade, definindo como enquadro delimitador o sistema presidencialista. A pesquisa é iniciada identificando o exercício da governabilidade – bem como das teorias que visam explicar seu modus operandi – diante da lógica de um Estado democrático e de direito. Prontamente, o estudo segue explorando as adversidades de manutenção dessa governabilidade em um sistema democrático que opere em arenas permeadas pelo fenômeno da globalização, considerando os múltiplos agentes e fatores decorrentes dessa relação. No segundo capítulo, aprofunda-se a perquirição com fito de estabelecer uma associação mais profunda entre a governabilidade e os elementos axiológicos de um sistema constitucional: os princípios. O intuito é o de delimitar e vincular a atuação presidencial com disposições jurídico-constitucionais dos ordenamentos. O terceiro e último capítulo debate especificamente as situações de crise e descrença na legitimidade de instituições democráticas. É examinada a possibilidade de deturpação ou ressignificação do Impeachment, prática recorrente em alguns regimes presidenciais, enquanto instrumento jurídico-político para solver incidentes de ingovernabilidade. Finalmente, são sugeridas possibilidades de resolução do problema da (in)governabilidade sob o prisma do ordenamento jurídico-constitucional, enquanto alternativa para rupturas drásticas com as disposições democráticas de uma nação e a descaracterização do presidencialismo enquanto sistema político-democrático.

At first, this dissertation faces the challenge of exposing the dimensions and meanings of the term governability, defining as a bounding framework the presidential systems. The research begins identifying the exercise of governability - as well as the theories that aim to explain its modus operandi - before the logic of a democratic State of law. Promptly, the study continues to explore the adversities of maintaining this governability in a democratic system that operates in arenas permeated by the phenomenon of globalization, considering the multiple agents and factors resulting from this relationship. In the second chapter, exploration is deepened in order to establish a deeper association between governability and the axiological elements of a constitutional system: the principles. The aim is to delimit and link the presidential performance with a legal and a constitutional provisions of the legal systems. The third and final chapter specifically discusses situations of crisis and mistrust in the legitimacy of democratic institutions. The possibility of misrepresentation or re-signification of Impeachment, a recurring practice in some presidential regimes, is examined as a juridical-political instrument to solve incidents of ungovernability. Finally, possibilities of solving the problem of (in)governability from the prism of the legal-constitutional order are suggested, as an alternative to drastic ruptures with the democratic dispositions of a nation and the de-characterization of presidentialism as a political-democratic system.
