Abstract: Considerando a carência de estudos de aprofundamento doutrinário sobre a imunidade parlamentar no Brasil e, igualmente, a quase ausência integral de pesquisas de atualização do texto constitucional sobre ela, bem como a grande variabilidade de entendimentos jurisprudenciais nesse tocante e o crescente avanço da complexidade entre os paradoxos da imunidade parlamentar – a própria Constituição porta-se em contrariedade entre os artigos de texto da imunidade parlamentar e os princípios e os valores do Estado Constitucional Democrático, pelos direitos fundamentais. A gênesis constitucional da imunidade parlamentar vê-se, atualmente, desintegrada das finalidades da representação política. Dessa maneira, a imunidade parlamentar presta-se a proclamar o Estado Constitucional ou a proteger interesses? Objetiva-se provocar o despertar para a problemática, em virtude de tamanha incongruência entre o texto constitucional (“congelado”) e a atualidade cotidiana (“de excessos/desvios/corrupções”), fazendo-se um levantamento doutrinário e jurisprudencial sobre a imunidade parlamentar, passando-se pela análise também textual das Constituições de diversos países, em estudo de direito comparado – para propor-se conclusivamente algumas alterações ao ordenamento constitucional brasileiro, como forma de resposta-sugestão à problemática enfrentada. Para tanto, procede-se à pesquisa pela metodologia, em parte, exploratório-teórica, ao explicitar o levantamento bibliográfico doutrinal, legal e jurisprudencial sobre o tema; quanto ao método de abordagem a tese é também fenomenológica ao propor a construção da realidade social compreendida-almejada; em sua forma analítica, a abordagem é dedutiva, ao amparar-se em premissas gerais aceitas como satisfatórias. No âmbito do direito comparado, o método utilizado é o funcional ao perceber-se funções semelhantes entre ordenamentos diferentes e o declaratório, ao pesquisar e prestar declarações à tarefa comparatista. Desse modo, observa-se que a imunidade parlamentar perdeu identidade social do seu texto constitucional às práxis políticas representativas hodiernas. Enquanto o texto constitucional manteve-se “congelado”, a sociedade em mutação constante gera a cada minuto novas situações sobre a imunidade parlamentar. Por conseguinte, o texto constitucional não mais responde adequadamente aos problemas advindos desse instituto. Assim, a irresponsabilidade parlamentar ganha uma atribuição de sentido diverso daquele originário em sua essência, isso porque o exercício das funções de parlamentar não pode ser confundido com as funções pessoais de parlamentar. Ademais, a inviolabilidade parlamentar concede ao membro do Parlamento um status de “acima da lei”, por sua infundada motivação em tempos de século XXI, de representação política moderna. O que se permite concluir como resposta-sugestão ao sistema constitucional brasileiro que a irresponsabilidade parlamentar há de ser analisada sob a divisão de subjetiva e objetiva. Na primeira, salvaguarda-se a liberdade de expressão, a liberdade intelectual, a crítica, o juízo de valor – podendo o membro parlamentar, nos casos de excessos ou desvios, responder perante o controle interno; por outro lado, por difamação grave, responsabilidade civil e direito de resposta (a ser analisada pelo Parlamento). Na irresponsabilidade parlamentar objetiva, está-se protegendo a liberdade de informar, denunciar, esclarecer, prestar juízo de fato – podendo responder, o membro parlamentar, nos casos de excessos ou desvios, por calúnia e pela responsabilização civil. Já a inviolabilidade parlamentar, há de ser vislumbrada como institucionalfuncional e institucional-pessoal. Naquela, encontram-se duas exceções ao poder de o Parlamento sustar o trâmite processual nos casos de recebida a denúncia, no Poder Judiciário, contra membro parlamentar: na hipótese de reeleição do parlamentar; e nos casos em que a denúncia recebida trate-se de crime de corrupção, perigo à segurança nacional ou à ordem pública. Na inviolabilidade parlamentar institucional-pessoal, abrese uma exceção à prisão de membro parlamentar fora do flagrante delito por crime inafiançável: nas hipóteses de perigo à segurança nacional, à ordem pública ou por crime de corrupção – com julgamento confirmado em segundo grau de jurisdição ou decretado pelo Pleno da Suprema Corte.
Considering the shortage of studies on doctrinal depth of the parliamentary immunity in Brazil, likewise the nearly absence of updated researches on its regard to the constitutional text; furthermore, its great variance of jurisprudential understandings and the increasing progress complexity among the paradoxes of parliamentary immunity – the own Constitution runs into contradiction on its parliamentary immunity text articles and the principles and values of the Democratic Constitutional State, through fundamental rights. The constitutional genesis of parliamentary immunity is currently disintegrated from the political representation functions. Thus, does the parliamentary immunity render itself to proclaiming the Constitutional State or to protecting interests? The aim is to provoke an awakening to the problem by such incongruity between the “frozen” constitutional text and the daily reality “of surpluses/deviations/corruption” through doctrinally and jurisprudentially researching the parliamentary immunity, thereafter, also over a textual analysis of several countries Constitutions in the course of comparative law – hence, conclusively proposing some alterations to the Brazilian constitutional legal order as a form of response or suggestion to the problem faced. Therefore, to explicit the subject’s doctrinal, legal and jurisprudential bibliographic survey, the research is carried out partially by theoretical exploratory methodology. As to the method of approach, the thesis is also phenomenological when proposing the construction of the understood and aimed at social reality, and deductive in its analytical form when relying on general assumptions as satisfactory. In the scope of comparative law, the method is functional when noticing similar functions between different legal orders and declaratory when researching and testifying to the comparative task. Thus, it’s observed that the parliamentary immunity has lost its social identity from its constitutional text to the current representative political praxis. Whilst the constitutional text remained "frozen", the constant changeable society minutely generates new situations about the parliamentary immunity, thereupon, it no longer responds appropriately to the problems arising from this institute. Therefore, the parliamentary irresponsibility attributes to a diverse sense from the original one in its essence, for the exercise of parliamentary duties cannot be baffled with the parliamentary personal functions. In addition, the parliamentary inviolability grants the Member of Parliament a status of "above the law" due to its unfounded motivation in the times of the 21st century, a modern political representation. We are allowed to conclude, as a suggestive response to the Brazilian constitutional system, that the parliamentary irresponsibility should be analyzed under the subjective and objective divisions. In the subjective, safeguarding the freedom of expression, the intellectual freedom, the criticism, the judgment of values in which the Member of Parliament may take liability reporting to the internal control in the cases of surpluses or deviations, likewise, in severe slander, in liability for damages and the right to report back (to be analyzed by the Parliament). In the objective, the freedom to charge, to inform, to clarify, and judgment of facts are being protected in cases of surpluses, deviations, slander and civil liability in which the Member of Parliament may respond. Yet, the parliamentary inviolability should be seen as institutional-functional and institutional-personal. In the institutionalfunctional, two exceptions are made to the Parliament powers as to halt the procedural proceeding in cases of sustained charges in the Judiciary against Members of Parliament: in the event of Member’s re-election, and cases whose charges are corruption crime, danger to national security or to the public order. In the institutionalpersonal, one exception is made to the arrest of a Member of Parliament off the flagrante delicto for non bailable offenses: in the events of danger to national security, to public order or corruption crime whose sentence is confirmed by a higher jurisdiction court or enacted by the Supreme Court Plenum.
