Proteção para quem? Lei Maria da Penha e as mulheres Trans

Abstract

Este trabalho é uma versão atualizada e modifcada do artigo publicado nos Anais do IV Enlaçando Sexualidades UNEB - Salvador Bahia, 2015 e reflete sobre a aplicação da Lei Maria da Penha a mulheres transexuais e como possíveis divergências se apresentam. Desde o desconhecimento pelos/as magistrados/as dos conceitos de gênero e sexo, perpassando decisões judiciais e a importância de uma interpretação teleológica da Lei em questão. Ainda destaca conceitos sociológicos importantes para o cumprimento dos objetivos políticos e axiológicos dessa Lei, até chegar a propostas legislativas atuais, como o Projeto de Lei nº 8032/2014 proposto pela deputada federal Jandira Feghali, que ainda se embaraçam em exigências e proposições restritivas e não garantidoras de direitos para essas pessoas.

This work is an updated and modifed version of the article published in the Annals of the IV Enlaçando Sexualidades UNEB - Salvador Bahia, 2015 and reflects on the application of the Maria da Penha Law to transsexual women and how posible divergences present themselves. From the ignorance of the judges about the concepts of gender and sex, including judicial decisions and the importance of a teleological interpretation of the respective Law. It also highlights important sociological concepts for the fulfllment of the political and axiological objectives of this Law, until arriving at current legislative proposals, such as the one no. 8032/2014 proposed by the federal deputy Jandira Feghali, who still embarrass themselves in restrictive demands and propositions. guaranteeing rights for such persons.
