Justiça Machista? Uma Análise Sobre o Estereótipo de Género no Seio das Decisões Judiciais

Abstract

Vivemos tempos paradoxais, se por um lado, temos um Direito mais igualitário e cuja a evolução legislativa permitiu, ao longo dos tempos, consignar diversos mecanismos de salvaguarda e proteção dos direitos das mulheres, por outro lado, a mulher continua a ser alvo de fenómenos discriminatórios, que de forma subtil a subjugam e inferiorizam. A presente dissertação pretende demonstrar que a mulher é ainda, nos dias de hoje, vítima de um sistema hierarquizado, que a coloca num patamar inferior ao do homem e em que o Direito sustenta esse mesmo sistema. A pertinência do tema surge numa atualidade que é continuamente massacrada por episódios onde o tratamento desfavorável das mulheres vem ao de cima, através de decisões judiciais providas de estereótipo, em relação às mesmas. A existência de múltiplos tratados internacionais, como são o exemplo da Convenção sobre a Eliminação de Todas as Formas de Discriminação contra as Mulheres ou a Convenção do Conselho da Europa para a Prevenção e o Combate à Violência contra as Mulheres e a Violência Doméstica, vieram salvaguardar e reforçar os Direitos Humanos das Mulheres. A própria Constituição da República Portuguesa apresenta um vasto catálogo de direitos fundamentais, constituindo o artigo 13º "Princípio da Igualdade" um dos pilares do sistema democrático. Afinal onde está o problema? Através da análise de jurisprudência recente poderemos perceber de que forma o estereótipo de género ainda resiste nos tribunais e é perpetuado pela figura dos juízes. Uma análise sobre alguns casos judiciais que irão suscitar uma reflexão e análise acerca da problemática do estereótipo de género e na forma como interfere na justiça.

We live in paradoxical times, if on the onde hand, we have a more egalitarian Law and whose legislative evolution has allowed, throughout the ages, to record various mechanisms for safeguarding and protecting women's rights. On the other hand, women continue to be a target to discriminatory phenomena, which subtly subjugate and undermine her. The present dissertation intends to demonstrate that the woman is still, nowadays, the victim oh a hierarchical system, which places her on a lower ground than men, something that the Law still supports. The pertinence of the theme arises in a current that is continually massacred by episodes where the unfavorable treatment of women comes to the top, through stereotype judicial decisions, in relation to them.The existence of multiple international treaties, such as the Convention on the Elimination of All Forms of Discrimination against Women or the Council of Europe Convention on preventing and combating violence against women and domestic violence, have safeguarded and strengthen women's human rights. The Constitution of the Portuguese Republic itself presents a vast catalog of fundamental rights, and Article 13 "Equality Principle" constitutes one of the pillars of the democratic system. So where is the problem?Through the analysis of recent jurisprudence, we can see how the gender stereotype still persists in the courts and is perpetuated by the figure of the judges.An analysis of some judicial cases that will give rise to a reflection about the gender stereotype problem and how it interferes with justice.
