No que concerne a este direito do arguido à não autoinculpação, iremos manifestar a nossa posição no sentido de não adotar uma perspetiva minimalista, reduzindo o mesmo ao direito ao silêncio. Estamos em crer que o alcance da proteção oferecida por esta garantia Constitucional, extravasa largamente o âmbito das declarações do arguido.Como suporte da posição adotada, será passada em revista jurisprudência sobre a temática em apreço com a consequente apreciação critica.O direito punitivo do Estado no campo rodoviário assume-se como incontornável no paradigma sancionatório do ilícito de mera ordenação social, seja pelo amplo espectro de abrangência, seja pelo volume processual que origina, em virtude de ser um “direito gerador de contraordenações em massa”, o que justifica e legitima o presente estudo. In this dissertation we proceeded to the analysis of the Road Offence Law as a manifestation of the ius puniendi of the State, placing it in the space that occupies in the framework of the legal system.We intended to study the conceptual scheme of traffic ticket, in its essential elements.It will analyse the different species of sanctions related with traffic regulations, and the margin of decision-making freedom of the Administration, concerning its application, considering the measurement criteria.We will study the mechanisms that assist the defendant in the right of defence, supported by the constitutional principles, explaining how they are transposed to the process of judicial control.The scope of the constitutional principle of the Nemo Tenetur se Ipsum Accusare is subject to scrutiny in the road sanction procedure, mainly in the context of carrying out the alcohol test and the delivery of documents by the driver.With regard to this right of the accused to non-self-incrimination, we will express our position that we do not adopt a minimalist perspective, reducing the same to the right to silence.We believe that the scope of the protection offered by this Constitutional guarantee goes far beyond the scope of the defendant's statements.In support of the position adopted, case law will be reviewed on the subject in question with the consequent critical appraisal.The punitive right of the State in the road field is assumed as essential in the sanctioning paradigm of the illegality of mere social ordering, either by the wide range of coverage, or by the procedural volume that it causes, because it is a "right that generates mass misconduct "; which justifies and legitimizes the present study. |
