A figura dos gestor dos contratos públicos como bastião para o movimento de profissionalização da contratação pública em Portugal

Abstract

A presente dissertação foi elaborada no âmbito do Mestrado em Ciências Jurídico-Políticas com Menção em Direito Administrativo e versa principalmente sobre a figura do gestor dos contratos públicos introduzida pelo “novo” Código dos Contratos Públicos implementado por meio do Decreto-Lei nº 111-B/2017, de 31 de agosto, e com vigência a partir do primeiro dia de 2018. O trabalho demonstra que a criação desta figura, além de ter sido um pedido, em alguma medida, do Tribunal de Contas de Portugal, foi em grande parte fomentada pela União Europeia, influenciada por movimentos originados a partir dos fins das Grandes Guerras, com contornos mais expressivos a partir da década de sessenta e setenta do século passado, por meio dos Estados Contratante, Regulador e Garantidor. Analisando a concepção do gestor dos contratos públicos, demonstramos os movimentos da União Europeia em relação à Contratação Pública, realçando a mudança e o início de uma preocupação com a execução do contrato. Em seguida, analisamos pormenorizadamente a figura do gestor e aspectos que lhe são atinentes, como o conceito, o momento e a forma de designação, impedimentos e funções. Demonstramos que os movimentos de uma governação por resultado fomentados pela União Europeia, o gestor seria um grande fomentador do movimento de profissionalização da contratação pública em Portugal e na União Europeia, buscando uma certa padronização de habilidades, ferramentas e desempenho de suas funções por meio de uma caixa de ferramentas disponibilizada à Administração Pública e seus integrantes.

This work was developed in the Master's Programme in Legal and Political Sciences with mention in Administrative Law. It deals especially with the figure of the manager of the public contracts introduced by the “new” Code of Public Procurement implemented last year by the Decree-Law nº 111-B / 2017, of August 31 and effective as of 2018. The work shows that the creation of this figure, in addition to being a request to some extent, Portugal’s Accounting Office was largely fostered by the European Union, under the influence of movements that emerged after of the two World Wars, though with more expressive contours from the sixties and seventies of the last century, through the Contracting, Regulator and Guarantor State. An analysis of the notion of public procurement manager demonstrates the efforts of the European Union to make Public Procurement more professional, emphasizing the change and the beginning of European concern with the implementation of the contract. Next, we examine in detail the figure of the public procurement manager and its aspects as the concept, the moment and the form of designation, impediments and functions. We demonstrate that the efforts of the governance by results provided by the European Union, the figure of the public procurement manager would be a major fomenter of the professionalization movement into the Public Procurement in Portugal and European Union, seeking a certain standardization of skills, tools and performance of its functions through a toolbox made available to the Public Administration and its members.
