Terrorismo e Crimes Contra a Humanidade

Abstract

O presente estudo incide sobre o fenómeno do terrorismo e na sua configuração perante o Direito Internacional Penal. O terrorismo não ascende ao estatuto de crime internacional em virtude da discordância e apreensão dos Estados em relação a esta figura, apesar dos esforços nesse sentido. Os atentados de 11 de Setembro de 2001 chocaram a comunidade internacional e marcaram um novo panorama na história do terrorismo pela sua violência e dimensão, sendo classificados como crimes contra a humanidade por diversas personalidades. Deste modo, o trabalho é iniciado por uma exposição sobre a responsabilidade internacional penal do indivíduo, de forma a determinar o seu conteúdo e apurar os mecanismos de reforço do Direito Internacional Penal.O capítulo seguinte incide sobre os crimes contra a humanidade.É feito um excurso histórico sobre o seu surgimento e evolução até à actualidade. Seguidamente, são analisados os elementos que constituem estas ofensas e, por fim, são elaboradas algumas considerações sobre os interesses protegidos através da constituição destes crimes.O terceiro capítulo da dissertação concentra-se no fenómeno do terrorismo. Após uma exposição sobre a sua evolução histórica, são apresentadas as problemáticas relacionadas com a criação de um crime internacional de terrorismo e os esforços nesse sentido.No último capítulo, é analisada a configuração do terrorismo como crime internacional, seja de forma autónoma, postulada pelo direito costumeiro, seja integrado noutras categorias de crimes.Após a análise das características dos crimes contra a humanidade, verifica-se que os atentados terroristas praticados de forma sistemática ou em larga escala são subsumíveis nesta categoria, abrindo-se o caminho para a responsabilidade internacional dos seus autores.

The present study focuses on the fenomenon of terrorism ans its configuration on International Criminal Law.Terrorism is not a international crime due to the States disagreement and apprehension on that matter, in spite of all the efford made on that path.The attack on September 11th, 2001 chocked the international community and set a new era on the history of terrorism by its violence and dimention, being classified as a crime against humanity by several personalities.On that note, this thesis starts with an exposition about the international criminal responsability of the individual, in order to determine its content and the mecanisms of reinforcement of the International Criminal Law.The next chapter focuses on crimes against humanity.It is presented an historic path, since its first appearance until nowadays. It is followed by the analysis of the elements theses ofenses and, by last, some considerations about the values protected by the creation of these crimes are made.The third chapter of the dissertation focuses on the fenomenon of terrorism. After an historic evolution, the issues with the creation of an international crime of terrorism and the effords made on that way are discussed.In the final chapter, it is analised the configuration of terrorism as an autonomous crime, set by custom, or integrated in other categories of international crimes.After an analysis of the characteristics of the crimes against humanity, one can notice that the terrorists attacks that are part of a widespread or systematic practice can be integrated on this category, openning the way to the international responsability of its authors.
