Abstract: No presente trabalho almejou-se elucidar o bailout e o bail-in, que apresentam-se como mecanismos de resolução, instrumentos de resgate a uma instituição financeira. Quando uma instituição financeira exibe perdas, esta não deve passar pelo processo de insolvência ou ainda de falência que passaria outras instituições não financeiras, para instituições financeiras faz-se necessário um mecanismo específico, qual seja, o bailout ou o bail-in. Portanto abordaremos dentro deste contexto dois instrumentos o bailout e o bail-in, para tal, posicionar-se-á um em oposição ao outro, apresentando suas distinções, vantagens e desvantagens, bem como, o funcionamento de cada instrumento e o principal contraste entre ambos que seria seu financiamento, além disso, ainda abordaremos a regulação de cada instrumento, uma vez que, para que possam ser utilizados necessitam estar regulamentado na legislação. O bailout sempre fora o mecanismo mais utilizado, por poder ser utilizado de maneira imediata, mas após a crise iniciada em 2007, este perdeu credibilidade, pois notou-se com a crise alguns pontos que necessitavam de modificações, tal como, a desregulamentação do sistema financeiro, instituições grandes demais para falhar, falharam, dentre outros pontos que abordaremos no presente trabalho que não viabilizavam mais o uso do bailout, desse modo, passou a regular mecanismos de resolução entre eles o bail-in, este por sua vez delonga um certo tempo para que possa ser utilizado e surta os efeitos desejados. Analisaremos ainda as justificativas que levam a uma resolução e brevemente os riscos que esta evita.
In the present work, it was sought to elucidate bailout and bail-in, which present themselves as mechanisms of resolution, instruments of redemption to a financial institution. When a financial institution exhibits losses, it should not go through insolvency proceedings or bankruptcy that other non-financial institutions, financial institutions require a specific mechanism, namely bailout or bail-in. Therefore, we will approach in this context two instruments, bailout and bail-in. In order to do this, we will place one in opposition to the other, presenting its distinctions, advantages and disadvantages, as well as the operation of each instrument and the main contrast between both of which would be their financing, in addition, we will still address the regulation of each instrument, since to be used they need to be regulated in the legislation. Bailout had always been the most widely used mechanism, since it could be used immediately, but after the crisis that began in 2007, it lost credibility, as some of the points that needed to be modified were deregulated, such as deregulation of the system financial, institutions too big to fail, failed, among other points that we will address in the present work that did not make the use of bailout more feasible, in this way, it began to regulate mechanisms of resolution among them the bail-in, this in turn delays a certain time for it to be used and has the desired effects. We will also analyze the justifications that lead to a resolution and briefly the risks it avoids.
