Justiça Restaurativa na perspectiva sistémica de Niklas Luhmann

Abstract

The purpose of this work is to seek an approximation between restorative thinking and Niklas Luhmann's systemic theory, seeking to understand restorative justice as an autonomous subsystem of social communication that emerges in the contemporary world, in the perspective adopted here, as a way of reducing the complexity of the criminal justice system. In this way, it will be sought to investigate this new model of reaction to crime and to reflect on restorative justice, not as a mere amusement mechanism to be operated by the penal system, since it already has its own, though not sufficient, mechanisms for the realization of its aims, but as a new non-judiciary social system that, alternatively or complementary to the penal system, contribute to social pacification, since it selects from the crime the restorative sense to operate in the interpersonal dimension of the conflict that originates in the criminal episode This system aims to achieve a subjective justice that meets the real need of the actors, considering each of them as a personal system endowed with autonomy to manage the conflict itself. For this, we will start from the assumption of the existence of social systems as theorized by LUHMANN, not reducing it to a simple method of interpreting reality. In this regard, we will try to reflect on the possibility of understanding Restorative Justice as an emerging social subsystem that aims to respond to the crime that is different from that provided by the penal system, in a society understood as an autopoietic system of communication. Thus, we begin with the analysis of some concepts of the Luhmannian theory that, it is believed, allows such an approximation and, in the end, we will reflect on restorative justice from a systemic perspective.

A proposta deste trabalho é a de procurar uma aproximação entre o pensamento restaurativo e a teoria sistémica de Niklas Luhmann, buscando compreender a justiça restaurativa como um subsistema autónomo de comunicação social que surge na contemporaneidade, na perspectiva que aqui se adota, como forma de reduzir a complexidade do sistema penal. Buscar-se-á, dessa maneira, perquirir esse novo modelo de reacção ao crime e refletir sobre a justiça restaurativa não como um mero mecanismo de diversão a ser operado pelo sistema penal, pois este já dispõe de mecanismos próprios, embora não suficientes, para a realização de suas finalidades, mas como um novo sistema social não judiciarizado que venha, de forma alternativa ou complementar ao sistema penal, contribuir para a pacificação social, porquanto seleciona do crime o sentido restaurativo para operar na dimensão interpessoal do conflito que se origina no episódio criminoso. Tal sistema visa alcançar uma justiça subjetiva que atenda a necessidade real dos intervenientes, considerando, cada um destes, como um sistema pessoal dotado de autonomia para gerir o próprio conflito. Para tanto, partiremos do pressuposto da existência de sistemas sociais tal como teorizada por LUHMANN, não a reduzindo apenas a um simples método de interpretação da realidade. Buscar-se-á, nessa medida, refletir sobre a possibilidade de se compreender a Justiça Restaurativa como um subsistema social emergente que pretende dar uma resposta ao crime diversa da fornecida pelo sistema penal, em uma sociedade entendida como um sistema autopoiético de comunicação. Assim, iniciamos com a análise de alguns conceitos da teoria luhmanniana que, segundo se crê, permite tal aproximação e, ao final, refletiremos sobre a justiça restaurativa numa perspectiva sistémica.
