O abuso do direito nas relações de consumo

Abstract

O abuso do direito, pela sua potencialidade de alcance horizontal e sistêmico em todo o Direito, bem como por sua capacidade de sindicar uma quase infinidade de comportamentos possíveis, continua desafiando a doutrina e a jurisprudência quanto aos seus fundamentos essenciais e âmbito de aplicação. A questão ganha relevo no chamado mercado de massas, com sua pluralidade de relações jurídicas em que o consumidor normalmente se figura como parte vulnerável. O presente estudo objetiva analisar a figura do abuso do direito, sob a perspectiva das relações jurídicas de consumo. Neste horizonte, procura-se entender se a legislação em defesa do consumidor é capaz de imprimir uma nova abordagem conceitual da figura do abuso do direito, considerando, para tanto, os paradigmas próprios do direito do consumo. Assim é que, após uma necessária contextualização teórica do abuso do direito, notadamente a partir do escrutínio do art. 334º do Código Civil de Portugal, e das relações consumeristas, passa-se ao enfoque das chamadas práticas abusivas, da publicidade abusiva e das cláusulas abusivas, dada a correlação entre estas categorias e o abuso do direito. Ao final, aborda-se, em perspectiva, a aplicação do abuso do direito nas relações de consumo sob o manto da boa-fé objetiva, bem como a verificação de atos abusivos praticados pelos próprios consumidores. Ressalte-se que a pesquisa bibliográfica, tanto de obras produzidas por juristas portugueses, como por autores brasileiros, foi a principal metodologia aplicada à investigação, sendo certa, desde o início, a impossibilidade de se esgotar assunto tão amplo e complexo, a ser desafiado em futuras investigações de maior robustez.

The abuse of the rights, because of its potential horizontal and systemic scope throughout the law, as well as its ability to syndicate a myriad of possible behaviors, continues to challenge doctrine and jurisprudence as to its essential foundations and scope. The issue is gaining ground in the so-called mass market, with its plurality of legal relationships in which the consumer is usually seen as a vulnerable adherent part.The present study aims at analyzing the figure of abuse of rights, from the perspective of legal relations of consumption. In this context, it is sought to understand whether consumer protection legislation is capable of configuring a new conceptual approach to the concept of abuse of rights, considering, therefore, the specific paradigms of consumer law. Thus, after a necessary theoretical contextualization of the abuse of rights, notably from the scrutiny of art. 334 of the Civil Code of Portugal, and consumer relations, the focus is on so-called abusive practices, abusive advertising and abusive clauses, given the correlation between these categories and abuse of rights. In the end, the application of abuse of rights in consumer relations in the framework of objective good faith, as well as the verification of abusive acts practiced by the consumers themselves, is approached in perspective. It should be emphasized that the bibliographical research of works produced by Portuguese jurists as well as by Brazilian authors was the main methodology applied to the investigation, being sure, from the beginning, the impossibility of exhausting such a large and complex subject, to be challenged in future investigations of greater robustness.
