Abstract: A presente dissertação versa sobre a divergência instalada na doutrina e na jurisprudência portuguesas quanto à questão de saber qual via processual deve o senhorio adotar para colocar fim ao contrato de arrendamento urbano com fundamento na falta de pagamento de rendas nos termos do n.º 3 do art.1083.º do CC e, por conseguinte, para efetivar essa cessação, sempre que o arrendatário não proceda voluntariamente à desocupação e restituição do imóvel arrendado findo o contrato. Trata-se de um problema que surgiu em 2006, com o Novo Regime do Arrendamento Urbano (NRAU), aprovado pela Lei n.º 6/2006, de 27 de fevereiro, e que não encontrou solução com a reforma operada pela Lei n.º 31/2012, de 14 de agosto, que veio introduzir profundas alterações ao regime anterior. Inicialmente, iremos realizar uma abordagem aos contornos do despejo em Portugal até aos dias de hoje, atentando na respetiva evolução legislativa, bem como nos diferentes meios processuais de despejo que vigoram atualmente no ordenamento jurídico português. De seguida, iremos atentar na hipótese de mora do arrendatário na obrigação principal de pagamento da renda, na situação de resolução do contrato de arrendamento por iniciativa do senhorio com fundamento na falta de pagamento de rendas e no incumprimento da obrigação de desocupação do locado daí resultante. Por último, será alvo de análise o meio através do qual pode ser operada a resolução do contrato com o referido fundamento e a consequente efetivação da desocupação do locado, fazendo, para isso, menção às posições e argumentos avançados pela doutrina e jurisprudência a esse respeito.
The present dissertation deals with the divergence established in Portuguese doctrine and jurisprudence as to the question of which procedural process should the landlord adopt to terminate the urban lease agreement on the grounds of nonpayment of rents under the terms of no. 3, art. 1083 of the Portuguese Civil Code and, therefore, to effect such termination, whenever the lessee does not voluntarily proceed to vacate and refund the property leased after the contract. This is a problem that arose in 2006, with the New Urban Lease Regime (NRAU), approved by Law no. 6/2006, of February 27, and that did not find solution with the reform operated by Law no. 31/2012, of August 14, which introduced profound changes to the previous regime. Initially, we will take an approach to the contours of the eviction in Portugal up to the present day, considering the respective legislative evolution, as well as in the different procedural means of eviction currently in force in the Portuguese legal system. After, we will consider the hypothesis of default of the lessee in the main obligation of payment of the rent, in the situation of resolution of the lease on the initiative of the landlord on the grounds of nonpayment of rent and non-compliance with the obligation to vacate the resulting lease. Lastly, it will be analyzed the means by which the resolution of the contract with the aforementioned basis and the consequent effectiveness of the vacancy of the lease can be operated, making, for this, mention to the positions and arguments advanced by the doctrine and jurisprudence in this regard.
