Abstract: O presente estudo tem por escopo analisar a prevalência da norma negociada em detrimento da norma legislada no ordenamento jurídico-trabalhista brasileiro, português e francês, revisitando instituições-chaves do Direito do Trabalho, frente ao novo cenário econômico internacional. Tema relevante em virtude das recentes reformas nas legislações trabalhistas destes países, identificando uma tendência mundial de ampliação do papel da negociação coletiva nos ordenamentos jurídicos como forma de adequar as condições pactuadas da força de trabalho às exigências de competitividade e desenvolvimento econômico tanto reclamadas pelo setor patronal.
