Sabendo, de antemão, das dificuldades e não nos imiscuindo em discussões conceituais, faremos um périplo histórico pelas várias manifestações e mudanças nas caraterísticas do terrorismo, concluindo pela descrição de um novo tipo de terrorismo com conexões globais e cujas raízes não se encontram no dia 11 de Setembro, mas são mais profundas. Em face desta novel ameaça aos valores essenciais da comunidade, tendo presente a função do Direito Penal enquanto tutela subsidiária dos bens jurídicos, o legislador foi convocado a criar novos instrumentos normativos, ampliando o campo da punibilidade, sendo, por isso, perseguido pela sombra do direito penal contra o inimigo. A prevenção do terrorismo, atuando o Estado na antecâmara da tutela penal, faz parte da competência dos serviços de informações, com os meios que a lei lhes confere. A atomização dos agentes e a diversidade de métodos utilizados, aliado à multiplicidade dos canais de radicalização e a idiossincrasia das células terroristas impõe que se considere uma mudança no paradigma de atuação daqueles serviços, pondo à discussão a problemática da legitimidade do uso de escutas telefónicas.O único aspeto que tem permanecido uniforme no terrorismo é a ambiguidade da sua definição, apesar das inúmeras aceções sugeridas por investigadores ou entidades que se dedicam ao estudo e análise deste fenómeno. The only aspect that has remained even in terrorism is the ambiguity of its definition, although the innumerable meanings suggested by researchers or entities that are dedicated to the study and analysis of this phenomenon. Knowing, beforehand, the difficulties and not engaging ourselves in conceptual discussions, we will make a historical journey through the various manifestations and changes in the characteristics of terrorism, concluding by describing a new type of terrorism with global connections and whose roots are not found on September 11th, but are deeper. Given this new threat to the core values of community, bearing in mind the role of Criminal Law as subsidiary guardianship of Judicial assets, the legislator was called upon to create new normative instruments widening the field of punish ability and therefore persecuted by the shadow of criminal law against the enemy. Prevention of terrorism, the state acting in the ante-chamber of criminal justice is part of the competence of intelligence services with the means conferred by the law. The atomization of agents and the diversity of methods used, together with the multiplicity of channels of radicalisation and the idiosyncrasy of terrorism cells requires the consideration of a change in the paradigm of the performance of those services calling into question the problem of legitimacy of the use of the telephone tapping.The only aspect that has remained even in terrorism is the ambiguity of its definition, although the innumerable meanings suggested by researchers or entities that are dedicated to the study and analysis of this phenomenon.
