Contributo para a Compreensão da Relação Contratual de Fornecimento de Energia Eléctrica

Abstract

This study aims to clarify the legal classification of the electricity supply contract and to present the main aspects of its regime. A classification and a regime of delicate understanding due to the infrastructural, subjective and legal complexity that characterizes the sector, marked by a multiplicity of facilities, players and rules that together make up the provision of this essential public service.Following an introductory contextualization on the organization and functioning of the National Electricity System, the analysis focuses on the private contractual relationship established at the end of the supply process between suppliers and users, but that implies, for its full accomplishment, the participation of the operator of the network to which the consumer facility is connected.It is precisely this subjective triangle, together with the diversity of applicable rules, that gives rise to the questions that this study seeks to answer: being the supplier the entity that celebrates the contract with the user, selling the electricity consumed and receiving payment of the respective price, and being the network operator the entity responsible for the installation and maintenance of the meter, for the physical delivery of the electricity and its interruption, and for the measurement of the consumption to be invoiced by the supplier, who is the provider? What kind of contract is this? The contract binds who, before whom and in what aspects? What are the rights and duties of the parties? Who answers and to whom in case of non-compliance?The problem is addressed in three parts, comprising a general introduction, a chapter on the characterization of the subjects involved in the contractual relationship and a chapter dedicated to understanding the contract.

O presente estudo visa esclarecer a classificação jurídica do contrato de fornecimento de energia eléctrica e apresentar desenvolvidamente os principais aspectos do respectivo regime. Uma classificação e um regime de compreensão delicada, em razão da complexidade infra-estrutural, subjectiva e jurídica que caracteriza o sector, marcado por uma multiplicidade de instalações, protagonistas e normas que, no seu conjunto, conformam a prestação deste serviço público essencial.Partindo de uma contextualização introdutória em torno da organização e funcionamento do Sistema Eléctrico Nacional, a análise centra-se na relação contratual privada estabelecida no final do processo de fornecimento entre comercializadores e utentes, mas que implica, para a realização cabal do seu objecto, a participação do operador da rede a que a instalação consumidora se encontra ligada.É precisamente este triângulo subjectivo, conjugado com a diversidade de regras aplicáveis, que faz nascer as perguntas a que este estudo procura responder: sendo o comercializador a entidade que celebra o contrato com o utente, vendendo-lhe a electricidade consumida e dele recebendo o pagamento do correspectivo preço, e o operador da rede a entidade a quem cabe a instalação e manutenção do contador, a entrega física da electricidade e sua interrupção, e a medição do consumo a facturar pelo comercializador, quem é afinal o prestador? Que tipo de contrato é este? O contrato vincula quem, perante quem e relativamente a que aspectos? Quais os direitos e deveres das partes? Quem responde e perante quem em caso de incumprimento?A abordagem do problema faz-se em três partes, compreendendo uma introdução geral, um capítulo de caracterização dos sujeitos que participam na relação contratual e um capítulo dedicado à compreensão do contrato.
