Abstract: O alto índice de litigiosidade e a crença de que compete ao Estado, através do aparelhamento judiciário, resolver as controvérsias instauradas entre os indivíduos têm imperado nas sociedades portuguesa e brasileira.No presente trabalho, apreciamos a chamada mediação civil e comercial, um dos meios alternativos de resolução de conflitos, recentemente sufragada nas legislações de regência dos dois países e cuja importância ímpar merece ser difundida em razão dos seus inúmeros benefícios, a exemplo do restabelecimento da comunicação entre as partes envolvidas, da realização da justiça, da pacificação social e do resgate da dignidade dos indivíduos, sem prejuízo da celeridade processual, da redução de custos, da ausência de formalismo e rigidez de tramitação e do próprio crescimento das economias. Promovemos, em sede de direito comparado, um verdadeiro diálogo entre os regimes jurídicos atualmente vigentes nos dois lados do Atlântico, realçando as suas similitudes e diferenças e destacando os seus aspectos positivos e negativos, identificados na aplicação prática de tal mecanismo.Analisamos, de forma crítica, a chamada mediação obrigatória, trazendo a lume as suas vantagens e desvantagens e concluindo por não ser esta a melhor saída para o cenário que ora se descortina, em razão do vilipêndio à voluntariedade, consensualidade e autodeterminação das partes, além de dificultar o direito de acesso aos tribunais.Por derradeiro, ofertamos algumas ousadas propostas – (i) a difusão acadêmica da matéria, mediante a criação de uma cadeira multidisciplinar no âmbito dos cursos de licenciaturas (bacharelados) das Universidades, (ii) a “reinterpretação” do conceito legal de mediação, (iii) a redução significativa do valor das custas, (iv) a mediação como (quase) uma etapa do processo judicial e (v) a implementação de centros judiciários de solução consensual de conflitos –, tendo por finalidades a efetivação da mediação civil e comercial no seio das comunidades lusa e brasileira e, enfim, o seu reconhecimento como instrumento ideal na solução de conflitos.
The high index of litigiousness and the belief that it is due to the Estate, through the judicial apparatus, to solve the controversies established among individuals, have prevailed on portuguese and brazilian societies.In this work, we dealt the so-called civil and commercial mediation, one of the alternative means of conflicts solution, recently suffragated on the regency legislation of both countries and which unrivaled importance deserves to be widespread, due to its innumerable benefits, as an example of the resettlement of the communication among the integrant parts, the accomplishment of justice, the social pacification and the rescue of the dignity of individuals, without damages to the processual celerity, of the cost cut, absence of formality and the inflexibility of the tramitation as well as the peculiar growth of economies.We have promoted, in the sphere of compared law, a true dialogue among the current juridical regimes on both sides of the Atlantic Ocean, emphasizing its similarities and differences and also attaching the positive and negative aspects, that were recognized on the skilled application of such a device mechanism.We analysed, in a critical way, the so-called obligatory mediation, bringing to light its advantages and disadvantages, concluding that it was not the best scenario that one can disclose now in face of the vilification to spontaneousness consension and self-determination of the parts, besides rising difficulties toward hindering the right of access to the law courts.At last, we offer some courageous proposals – (i) the academic propagation of the subject, by means of the criation of a multidisciplinary branch of science, a chair among the courses of licensing (bachelorships) of the Universities, (ii) the “reinterpretation” of the legal concept of mediation, (iii) the significant reduction of the cost value, (iv) the mediation as (almost) a stage of the judicial process, and (v) the implement of judicial centers of consensual solution of conflicts –, having as a purpose the effectiveness core of the lusitanian and brazilian communities and, finally, their recognition of an ideal tool to solve conflicts.
