This Master Thesis aims to analyze the crime of Criminal Association, planned and punished by the article 299.º of Portuguese Penal Code. For this propose, what is intented is to approach the concept throughout history, questioning what leads the common man dazzle with organized societies for the practice of crimes.Specifically, are analyzed the historical arguments, the modalities and the special ways of appearing that define the type of crime as well as the organization itself, if we can call it that. With this intention, a critical analysis will be made of how portuguese jurisprudence and doctrine behave in this area, which, as will be seen, diverge from each other. For this is used a jurisprudential judgment of the subject. In the same way, it is concluded that, in the specific case, we are dealing with the figure of criminal co-payment, using the support of the doctrine to withdraw this conclusion. On the other hand, the jurisprudence shows the opposite, that is, even if the existence of an organization with hierarchy and structured functions is not proven, insists on attributing the punishment to the agent through the crime of Criminal Association. This Master Thesis aims to analyze the crime of Criminal Association, planned and punished by the article 299.º of Portuguese Penal Code.
