Abstract: O objeto de estudo desta investigação tem por base o fenómeno da dinâmica de planeamento urbano e a sua relação com os direitos urbanísticos preexistentes. Da dinâmica ao preexistente, analisarei o poder discricionário do planeamento urbano, as situações de salvaguarda e afetação dos direitos preexistentes, bem como o conceito destes, os factos pelos quais eles legitimamente se constituem e o seu conteúdo variável. The subject of study of this investigation is based on the dynamic phenomenon of urban planning and its relation with earlier urbanistic rights. I will traverse the discretionary power of urban planning, the preservation of situations or the legally harming of earlier rights, as well as the concept of these, and the fact by which they legally constitute themselves and their variable substance.
