dc.description.abstract | Os fatos que hoje permeiam as questões sobre a tipificação do crime de feminicídio no Brasil, têm origens que remontam à acepção do princípio da igualdade pelo Direito Internacional Público. A luta constante das mulheres pelo acesso aos direitos humanos e fundamentais, influencia transformações, erros e acertos no mundo jurídico - ora celebradas como progressos, ora ressaltando estatísticas do número de mortes por questões de gênero. Assim, essa pesquisa se propõe a investigar a tipificação do feminicídio no Código Penal Brasileiro a partir de duas óticas: I. sua implementação como ação afirmativa, analisando historicamente este instituto e as especificidades no que se refere a sua aplicação quando se trata de medida que busca igualdade material entre gêneros e II. as consequências geradas por esse processo jurídico-político, verificando-se a utilização do Direito Penal como ferramenta de implementação de medidas afirmativas, é viável para o alcance da igualdade material referida ou se necessita ser combinada com outras ações estatais. Para esta análise, foi imprescindível, em primeiro lugar, ressaltar como o feminicídio foi incorporado à ordem jurídica brasileira a partir de uma concepção latino-americana do vocábulo e da necessária influência do Direito Internacional como propulsor do reconhecimento deste crime e da violência de gênero, sobretudo a partir dos estudos dos casos Campo Algodoeiro e Maria da Penha. O que nos leva a refletir de maneira crítica se o Brasil procedeu à tipificação do crime de feminicídio e, portanto, a implementação de uma medida afirmativa, de acordo com as mais modernas orientações internacionais sobre gênero e direitos humanos. | por |
dc.description.abstract | The classification of feminicide as a criminal offense is an action against facts which dates back the Public International Law's acknowledgment of principle of equality. The persistent women's fight for human and fundamental rights, has an impact on transformation, mistakes and successes in the legal world - sometimes celebrated as achievements, sometimes highlighting statistical data about gender-based killings. Therefore, this scientific research investigates the criminal classification of feminicide in the Brazilian Penal Code considering two main axes: I. its implementation as an affirmative action, proceeding a historical analysis about the institute and their specificities in order to proceed the material equality between genders and II. the consequences evoked by this political-legal process, investigating if Criminal Law is sufficient as an only tool of affirmative action’s implementation or if it needs to be combined with complementary State measures. It was essencial to our study, in the first place, to verify that feminicide was incorporate by brazilian juridical order as a latin-american concept. In the second place, the influence made by the Internacional Law in the process of feminicides internal recognition as a crime, mainly after Maria da Penha and Campo Algodoeiro cases. In this regard and in order to conclude this scientific research, we'll pass through the analyses of Criminal Law as legal tool of affirmative action's fulfillment, and verify if classification made by brazilian law is in accordance with the main modern international orientation about gender and human rights. | eng |
