O DIREITO DE ASILO Uma perspectiva da União Europeia sobre um fenômeno global

Abstract

Com o efeito do processo de globalização e, também, do avanço dos meios de transporte, o fenômeno das migrações internacionais que se traduz na possibilidade do indivíduo se deslocar e fixar residência em outro país que não o seu de origem, tornou-se uma realidade típica da sociedade contemporânea, especialmente nos grandes centros urbanos onde já é possível ver nacionais e estrangeiros de diversas partes do globo convivendo num mesmo espaço físico. Portanto, o objeto da presente dissertação é provocar uma reflexão acadêmica sobre as vítimas de deslocamentos forçados no mundo atual sob uma perspectiva europeia. Deste modo, será exposto o desenvolvimento histórico do direito de asilo, dando especial atenção ao principal documento internacional na matéria: a Convenção Relativa ao Estatuto dos Refugiados de 1951. Posteriormente, será analisado como é o sistema de asilo na União Europeia à luz dos tratados, das diretivas, das resoluções e demais documentos comunitários sobre o asilo. Por fim, analisar-se-ão os dados globais e regionais do refúgio, em especial dos países que mais recebem essas pessoas e de onde esse grupo é proveniente. A partir de tais análises, será possível entender os desafios dos refugiados ao chegarem ao país de acolhimento, bem como vislumbrar a importância da integração local no contexto social, econômico e cultural. De todo modo, não há aqui qualquer pretensão em esgotar o tema porquanto isso não seria possível dada a sua complexidade. Contudo, esperamos que este estudo contribua para se vislumbrar o que já foi construído até o presente momento e quais os pontos precisam avançar em matéria de asilo, para que seja dada a cada homem, mulher ou criança uma nova oportunidade de gozar dos direitos e liberdades essenciais de uma vida digna.

With the effect of the globalization process and also the advance of the means of transport, the phenomenon of international migrations, which translates into the possibility of the individual moving to and staying in a country other than his or her country of origin, has become a reality of this contemporary society, especially in large urban centers where it is already possible to see nationals and foreigners from different parts of the globe living in the same physical space. Therefore, the scope of this dissertation is to provoke an academic reflection on the victims of forced displacement in the present world from a European perspective. In this sense, the historical development of the right of asylum will be exposed, paying particular attention to the most important international document on this subject: the 1951 Convention Relating to the Status of Refugees. Then, it will be analyzed how the asylum system works in the European Union, giving special attention to regional treaties, directives, resolutions and other documents on asylum. Finally, the global and regional data of asylum will be analyzed, especially the major refugee-hosting countries and major source countries of refugees. From there, it will be possible to understand the challenges of refugees when they arrive in the hosting country, as well as to understand the importance of local integration in the social, economic and cultural context. In any case, there is no pretension here to exhausting the subject as this would not be possible given its complexity. However, we hope that this study will contribute to a glimpse of what has been built up to date and which points need to be advanced in the area of ​​asylum so that every man, woman or child is given a new opportunity to enjoy the rights and freedoms essential for a dignified life.
