This research intends to analyze the relationship between the right to freedom of expression and other fundamental rights against the hate speech, and the reflecxion of this in the current democratic society, which is marked by economic, social and political disparities, suffer from the effects of discrimination, hatred and violence. For that, approaches the general and specific theoretical contours and the argumentative logics of concrete cases in different legal systems, which eventually allow the hate speech or restrict the fundamental right to freedom of expression. Thus, we intend to confront the issue, not only the prohibition of speeches or restriction of rights, based on state regulations or adequacy techniques, but also to reflect on the need to improve the development of tolerance and communicative liberties, beyond of a more effective educational policy, so that more tolerant societies are gradually formed, able of recognizing multiculturalism, pluralism and mutual respect for differences. This research intends to analyze the relationship between the right to freedom of expression and other fundamental rights against the hate speech, and the reflecxion of this in the current democratic society, which is marked by economic, social and political disparities, suffer from the effects of discrimination, hatred and violence.
