Abstract: The subject of private paternity testing, from a bioethical and medical-legal point of view, it has been increasingly debated in recent years, since we have seen a growth in demand from the consumer, driven in part by the development of, faster and cheaper, technologies for the study of the genome, as well as by its commercialization, which have become increasingly available via the internet and other means of social communication.The relevance and the opportuness of the study meets a growing concern of the scientific community, which has raised serious ethical issues, but also legal, on the way in which private biological filiation tests are conducted. The main themes addressed were defined according to the pertinence of ethical and medical-legal concerns, such as: informed consent, privacy, confidentiality, validity and quality of genetic testing, taking into account current practices in private markets and the existing regulatory framework. This is a situation that deserves the greatest concern, and it was also in this sense that the situations in which tests were carried out involving minors and prenatal period were particularly addressed.The main objective of this study is to review the already published literature on the subject, in order to evaluate and synthesize the main currents of opinion to determine the position of the scientific community. For the elaboration of this work, was carried out a research and analysis of articles, norms and codes of good practices, of guidelines and declarations of societies and organizations, national and international, which are considered respected and credible authorities. It was possible to conclude that private paternity testing present ethical and legal failings that undermine the protection of human rights.With regard to the private market responsible for marketing and testing, it is noted the lack of regulation and inspection of the same, as well as, it is verified that the methodology used in the collection of the biological samples is made under uncontrolled conditions, which do not comply with the technical and scientific recommendations of good practice. It is also concluded that the method practiced makes it possible to perform tests without the informed consent of one of the participants or without the participation of the other family members, which does not safeguard the respect for the right to privacy and confidentiality of individual genetic information.Regarding the prenatal period, it was found that it was ethically unacceptable to carry out an invasive technique with the purpose of performing tests of biological filiation, and with regard to the use of non-invasive techniques, it is concluded that it is a topic that should be more debated, there being a balance of arguments against and in favor. In situations where there is involvement of minors in the biological investigation of paternity, it is concluded that there is a risk of serious emotional, psychosocial and physical damage, as well as disruptive and disturbing family situations, with obvious consequences for the child's development.
O tema das investigações biológicas de paternidade a título privado, sob um ponto de vista bioético e médico-legal, tem sido nos últimos anos cada vez mais debatido, uma vez que assistimos a um crescimento da sua procura por parte do consumidor, alavancado, em parte, pelo desenvolvimento de tecnologias do estudo do genoma, cada vez mais rápidas e com menores custos, assim como pela sua comercialização, que cada vez mais é disponibilizada via internet e outros meios de comunicação social.A relevância e a oportunidade do estudo vai de encontro a uma crescente preocupação da comunidade científica, que tem levantado sérias questões de natureza ética, mas também legais, sobre o modo como são realizados os testes de filiação biológica a título privado. Os principais temas abordados foram definidos conforme a pertinência das preocupações éticas e médico-legais, tais como: o consentimento informado, a privacidade, a confidencialidade, a validade e qualidade dos testes genéticos, tendo em conta as práticas atuais nos mercados privados e o enquadramento normativo existente. Trata-se de uma situação que merece a maior preocupação e foi também nesse sentido que se abordou em especial as situações em que se efectuam testes envolvendo menores e no período pré-natal.O objectivo principal deste estudo consiste na revisão da literatura já publicada sobre o tema, com o intuito de avaliar e sintetizar as principais correntes de opinião para determinar o posicionamento da comunidade científica. Para a elaboração deste trabalho, realizou-se uma pesquisa e análise de artigos, de normas e códigos de boas práticas, de guidelines e declarações de sociedades e organizações, nacionais e internacionais, consideradas autoridades respeitadas e credíveis.Foi possível concluir que as investigações biológicas de paternidade a título privado apresentam falhas éticas e legais que colocam em causa a protecção dos direitos do Homem. Relativamente ao mercado privado responsável pela comercialização e realização dos testes, constata-se a falta de regulamentação e fiscalização do mesmo, assim como, verifica-se que a metodologia usada na recolha das amostras biológicas é feita em condições não controladas, que não cumprem as recomendações técnico-científicas de boas práticas. Conclui-se também que o método praticado possibilita a realização de testes sem o consentimento informado de um dos intervenientes ou sem a participação dos restantes elementos da família, o que não salvaguarda o respeito pelo direito de privacidade e confidencialidade da informação genética individual.Relativamente ao período pré-natal constatou-se ser eticamente inaceitável a realização de uma técnica invasiva com o intuito de realizar testes de filiação biológica, e no que diz respeito ao recurso a técnicas não invasivas conclui-se que é um tema que deve ser mais debatido, havendo um equilíbrio de argumentos contra e a favor. Nas situações em que há o envolvimento de menores na investigação biológica de paternidade, conclui-se haver o risco de sofrerem graves danos emocionais, psicossociais e físicos, assim como ocorrerem situações familiares disruptivas e a perturbadoras, com consequências óbvias para o desenvolvimento do menor.
