dc.description.abstractlei nº 5/2008 de 12 de Fevereiro veio aprovar a criação de uma base de dados nacional de perfis de ADN, para fins de identificação civil e criminal. Portugal concretizou assim a criação de um instrumento pericial com enormes potencialidades no âmbito da investigação criminal (e não só), tendo sido todavia um dos últimos países europeus a fazê-lo. Foram muitos os esforços desenvolvidos com este objectivo e particularmente amplo o debate prévio à aprovação da lei. Ainda assim, ou talvez por isso, a lei acabou por se caracterizar por uma perspectiva muito restritiva e, três anos depois da sua entrada em vigor, constata-se que a base de dados parece estar longe das suas potencialidades, vindo a comunicação social a salientar de forma crescente este facto e a fazer eco de múltiplas e diversificadas vozes sublinhando a necessidade da sua reformulação. Curiosamente, essas mesmas notícias não abordam os diversos problemas éticos suscitados pela base de dados nem as soluções preconizadas, que continuam a merecer uma fundamentada e cuidada reflexão. Com este trabalho, pretende-se avaliar a situação actual da base nacional de perfis de ADN portuguesa, compará-la com a realidade internacional, particularmente europeia, e discutir várias das inquietações éticas que a mesma ainda suscita. A criação da base nacional de perfis de ADN foi perspectivada com o objectivo de dotar o país com um valioso instrumento no âmbito da investigação criminal e da identificação de cadáveres. Três anos depois da sua entrada em vigor, constata-se que o texto legal a poderá estar a limitar no seu potencial, justificando-se, provavelmente, uma reapreciação do mesmo. Constata-se também que existem ainda múltiplas questões de natureza ética, legal e social dela decorrentes a necessitarem de reflexão. Será possível alargar e explorar o potencial desta nova realidade sem quebrar direitos básicos do ser humano? Existe protecção eficaz no que respeita à protecção de informação privada? Seria uma mais-valia o alargamento desta base de dados no sentido de maximizar a qualidade das investigações? Até que ponto pode ser feita a troca de informações entre países, problema não perspectivado nas discussões éticas iniciais? Estes são alguns exemplos dessas questões. dc.description.abstractThe Law No. 5 / 2008 of February 12th came to approve the creation of a national database of DNA profiles for purposes of civil and criminal identification. Portugal materialized thus creating an investigative tool with enormous potential in the context of criminal investigation (and beyond), but was one of the last European countries to do so. There have been many efforts to this end and particularly wide-ranging debate prior to the introduction of the law. Nevertheless, or perhaps because the law is characterized by a very narrow perspective, three years after its entry into pratice, it appears that the database seems to be far from its potential. The media increasingly emphasize this fact and making echo of the many voices stressing the need for its reformulation. Interestingly, these same news given by the media do not address the various ethical issues raised by the database nor the recommended solutions, that continue to deserve a careful and cautious reflexion. With this work, we intend to evaluate the current situation of the national base of DNA Portuguese profiles, compare it with the international situation, particularly in Europe, and discuss several of the ethical concerns that it still raises. The creation of a national database of DNA profiles was envisaged with the aim of providing the country with a valuable tool in criminal investigation and identification of corpses. Three years after its entry into force, it appears that the legal text may be limiting its potential, justifying probably a review of it. You'll notice that there are still many ethical issues, legal and social entailed the need for reflection. Is it possible to extend and exploit the potential of this new reality without breaking basic human rights? Is there effective protection with regard to the protection of private information? Would it be an asset to extend this database in order to maximize the quality of investigations? To what extent can we exchange information between countries, a problem not taken into account in the previous ethical discussions? These are some examples of the ethical issues.
