Regulação financeira e supervisão bancária : análise crítica das problemáticas do BPN, BPP, BES e Banif

Abstract

Esta dissertação versa sobre supervisão bancária, ainda que inclua um capítulo sobre regulação (sendo que, nesta, nos interessa essencialmente a regulação financeira). Assumindo a supervisão um tão grande destaque nos dias de hoje, não pudemos deixar de lhe dedicar um extenso capítulo, no qual se analisam as duas vertentes da mesma (a prudencial e a comportamental), a estrutura institucional nacional e europeia de supervisão, entre outros aspetos que nos ajudam a compreender a dinâmica desta temática. Tal compreensão revela-se imprescindível para se perceber quais as falhas na regulação (em especial as do Banco de Portugal) e supervisão das instituições bancárias cuja resolução analisamos no terceiro capítulo: o Banco Português de Negócios, o Banco Privado Português, o Banco Espírito Santo e o Banif – Banco Internacional do Funchal, S.A. Contribui de igual modo para entendermos se a legislação em vigor é a adequada, se o surgimento do Mecanismo Único de Supervisão veio facilitar ou dificultar a supervisão de instituições financeiras nacionais, fazendo assim um balanço da situação atual a nível da regulação financeira e da supervisão bancária. Abstract This thesis comprises banking supervision, even though it includes a chapter on regulation (from a specific financial regulation stand point). Considering that supervision currently holds such an importante place, we can’t not dedicate it an extensive chapter, in which two branches of the same (the prudential and behavioural) national and european institutional structure, among other aspects that help us understand this theme dynamics. Such understanding is indispensable to get the full picture on the regulation fails (specially the ones from Banco de Portugal), as well as the bank institution supervision whose resolution will be analised in the third chapter the Banco Português de Negócios, the Banco Privado Português, the Banco Espírito Santo and Banif. Likewise, it also contributes to understand if the legislation in force is the adequate one, if the emergence of the Single Supervisory Mechanism eases up or hampers the national finantial institutional supervision, which outlines a balance on the current situation finantially speaking, as well as banking supervision
