Abstract: A crise financeira que assolou os mercados em 2007 e 2008 revelou as debilidades do sistema financeiro europeu. A União Bancária surge como resposta, pois preconiza o reforço da resistência do sistema financeiro, a evitação do efeito de contágio, a destrinça entre a evolução da dívida soberana e a evolução da dívida bancária, a contenção do financiamento público das operações de bailout, o progresso da coordenação supervisora para a harmonização decisória e o impedimento da fragmentação dos mercados financeiros. A União Bancária assenta em três pilares: o Mecanismo Único de Resolução, em vigor desde 1 de janeiro de 2015, o Mecanismo Único de Supervisão, implementado a 4 de novembro de 2014 e o Sistema Europeu de Garantia de Depósitos, que ainda não vigora. O Mecanismo Único de Supervisão é o sistema através do qual o Banco Central Europeu detém as competências de supervisão prudencial sobre as instituições de crédito de todos os Estados-Membros da Eurozona. Desta forma, o Banco Central Europeu elege as melhores práticas de supervisão prudencial de entre os Estados-Membros participantes, para garantir uma supervisão harmonizada e homogeneizada dessas práticas de supervisão bancária e reforçar o sistema financeiro. Para o exercício das suas atribuições, o Banco Central Europeu assume uma supervisão direta sobre as instituições de crédito mais significativas e delega a supervisão das instituições de crédito menos significativas para as Autoridades Nacionais Competentes. Estas cumprem as suas atribuições de acordo com as orientações e recomendações do Banco Central Europeu. Se for condição para prossecução do interesse da supervisão europeia, o Banco Central Europeu pode evocar o exercício das suas atribuições no âmbito do MUS sobre as instituições de crédito menos significativas. Assim, a coordenação entre o Banco Central e Europeu e as Autoridades Nacionais Competentes é feita com base no princípio da cooperação e é um fator determinante para o sucesso do MUS. Após um ano e meio desde a sua implementação é possível fazer uma análise do seu sucesso até ao momento, atendendo aos objetivos delineados e alcançados. Esta retrospetiva é essencial para definir o que deve ser aperfeiçoado e quais os passos para o concretizar. ABSTRACT The financial crisis that hit the markets in 2007 and 2008 revealed the weaknesses of the European financial system. The Banking Union appears as the response, since it recommends strengthening the financial system’s resilience, avoiding the contagious effect, the distinction between the evolution of sovereign debt and the evolution of the bank debt, containment of public funding for the bailout operations, coordination progress supervisor for the operative harmonization and preventing the fragmentation of financial markets. The Banking Union is founded on three pillars: the Single Resolution Mechanism, in effect since 1st of January 2015, the Single Supervisory Mechanism, implemented on 4th of November 2015, and the European System of Guarantee Deposits. The Single Supervisory Mechanism is the system through which the European Central Bank has prudential supervision powers over the credit institutions of all Member States within the Euro zone. Thus, the European Central Bank elects the best supervisory practices among the participating Member States, to ensure a harmonized and homogenized supervision over those supervisory practices, and strengthen the financial system. To carry out its responsibilities, the European Central Bank takes on a direct supervision on the most significant credit institutions and delegates the supervision of the least significant credit institutions to the National Competent Authorities. These fulfill their tasks in accordance with the guidelines and recommendations of the European Central Bank. If it becomes a condition to pursue the interests of European supervision, the European Central Bank may invoke the exercise of its powers under the SSM on the least significant credit institutions. Thus, coordination between the European Central Bank and National Competent Authorities is based on the principle of cooperation and is a determining factor for the success of SSM. After a year and a half since its implementation it’s possible to make an analysis of its journey so far, considering the outlined objectives and achieved, and conclude for its success. This retrospective is essential to define what should be improved and which steps can materialize it
