Se assumirmos o direito e a justiça como fenómenos sociais e culturais, então um dos desafios que as sociedades enfrentam é o de incorporar as múltiplas identidades e as normas culturais numa estrutura ampla, articulando o direito à igualdade com o reconhecimento da diferença. Apesar de o paradigma normativo do Estado moderno assumir que em cada Estado só há um direito e que a unidade do Estado pressupõe a unidade do direito, este texto, a partir da análise de várias situações de interlegalidade (SANTOS, 1995) presentes na região austral de África, abre campo para uma leitura mais complexa do funcionamento sociojurídico destes estados modernos, a partir das epistemologias do Sul (SANTOS, 2007, 2014). For some time now, critical socio-legal studies have drawn attention to the need to convoke other forms of knowledge, besides the legal, to better understand what are law and justice. If we assume the law and justice are social and cultural phenomena, then one of the contemporary challenges is how to incorporate multiple identities and cultural norms in a wider structure, articulating the right to equality with the recognition of difference. Although the normative paradigm of the modern state assumes that in every state there is only one law and that the state unity presupposes the unity of the law, this text, based upon the analysis of various situations of interlegality (SANTOS, 1995) in southern Africa, opens the door for a more complex analysis of the socio-legal structure of modern African states, using the theoretical and methodological perspectives of the epistemologies of the South (SANTOS, 2007; 2014). |
