Abstract: Um dos recentes desafios para o direito internacional está relacionado com a revisão do papel tradicional do Estado com relação a um dos elementos centrais da soberania: o monopólio do uso da força. O fenômeno das empresas militares e de segurança privada é reflexo das mudanças operadas por força dos processos de globalização e que afetam sobremaneira as estruturas jurídico-políticas tradicionais. As graves violações de direitos em que estiveram envolvidas as empresas desse setor demonstram a necessidade de uma regulação eficaz para prevenir abusos, e requerem a aplicação de medidas para a atribuição de responsabilidade pelos ilícitos cometidos. Independente da responsabilidade criminal individual dos empregados das empresas militares, ou da responsabilidade corporativa, há que se investigar as situações que ensejam a responsabilidade internacional do Estado, seja quando permite a atuação dessas empresas para exercer atribuições do poder público, seja como responsável por assegurar a proteção dos direitos humanos. ABSTRACT One of the latest challenges for international law is related to the revision of the traditional role of the state in relation to one of its core elements of sovereignty: the monopoly of the use of force. The phenomenon of Private Miltary and Security Companies is an outcome of the changes ensued by virtue of globalization process and that greatly affect traditional legal and political structures. Serious rights violations involving companies in this sector demonstrate the need for effective regulation to prevent abuse, and require the application of measures for the attribution of responsibility for the crimes perpetrated. Regardless the individual criminal responsibility of the employees of military companies or the corporate responsibility, it is necessary to investigate the situations that give rise to the international responsibility of the State. These situations can be identified when the State allows these companies to exercise public duties, by authorizing them to exercise governamental authority, or when the State is the responsible for ensuring protection of human rights
