Abstract: As bases de dados de perfis genéticos têm como objetivo a identificação civil e criminal, no entanto, este objetivo só é alcançado se a base de dados for regulada por uma legislação eficiente. Uma legislação ineficaz diminui o potencial máximo da base de dados no combate à criminalidade. A elevada eficácia na resolução de crimes, demonstrada pela criação de bases de dados de perfis genéticos no Reino Unido e nos Estados Unidos da América, potenciou o desenvolvimento de bases de dados de ADN em muitos países. Contudo, o estabelecimento de uma base de dados de perfis de ADN pressupõe a necessidade de se criar legislação nacional, de modo a determinar os critérios de colheita e armazenamento de amostras biológicas, de inserção e remoção de dados e perfis genéticos na base de dados, etc. O objetivo deste trabalho foi realizar uma comparação entre os tipos de crime inseridos na base de dados portuguesa com os de outros países. Para além disto, pretendeu-se realizar uma análise da legislação nacional que regula a base de dados portuguesa para determinar se a legislação é a mais eficiente no que diz respeito à identificação de criminosos ou se necessita de sofrer algumas alterações. A comparação das legislações referentes às diferentes bases de dados dos vários países analisados, tais como Estados Unidos da América, Canadá, Reino Unido, Suécia, etc, permitiu observar que Portugal apesar de ter uma base de dados recente, a sua legislação é restritiva no que diz respeito à inserção e remoção de perfis genéticos da base de dados. Uma base de dados excessivamente restritiva irá conter um número reduzido de perfis de ADN inseridos, resultando numa menor eficácia da mesma. Na base de dados portuguesa, a maioria dos perfis genéticos inseridos dizem respeito a indivíduos que cometeram crimes leves, enquanto os que cometeram crimes violentos têm uma frequência mais reduzida, contudo o número de perfis genéticos inseridos é muito reduzido. Tal pode ser explicado pelo facto da legislação portuguesa restringir a inserção de perfis de condenados com pena de prisão igual ou superior a três anos e ainda ser necessária a ordem do juiz para que esta inserção seja efectuada. A legislação portuguesa que regula a base de dados deveria sofrer algumas alterações de modo a que a inserção de perfis genéticos não esteja dependente da autorização do juiz e possa incluir o máximo de perfis de criminosos possível, para que deste modo sejam prevenidos futuros crimes cometidos pelos mesmos.
Civil and criminal identification is the purpose of the DNA databases, however this purpose can only be achieved if the database is regulated by efficient legislation. Ineffective legislation will reduce the maximum potential of the database on fighting crime. The high efficiency in the resolution of crimes shown by the creation of DNA databases in the United Kingdom and in the United States of America led to the development of DNA databases around the world. However, the establishment of a DNA database presupposes the necessity to create national legislation in order to determine the criteria for sample collection and storage, for insertion and removal of genetic profiles in the database, etc. The aim of this work was to compare the types of crime included in the Portuguese DNA database with the ones of other countries. In addition, it is intended to conduct an analysis of the legislation which regulates the Portuguese database to determine if the legislation is the most efficient regarding the identification of criminals, or if it has to undergo some changes. The comparison of the national legislations regarding DNA databases of several countries analyzed, such as United States of America, Canada, United Kingdom, Sweden, etc., allowed the conclusion that although Portugal has a recent DNA database, it has a restrictive legislation concerning to the inclusion and removal of genetic profiles from the database. A database that is overly restrictive will have a low number of inserted DNA profiles, which will reflect a lower efficiency of the database. In the Portuguese DNA database the majority of the genetic profiles included are from criminals which have committed minor crimes, while those who have committed violent crimes have a lower frequency, however the total number of genetic profiles inserted is very low. This fact may be explained by the restrictive legislation which only allows the inclusion of genetic profiles of criminals sentenced to three or more years of incarceration and by the obligation of a judge order to this insertion be performed. The Portuguese legislation that regulates the DNA database should undergo some changes in order to facilitate the insertion of genetic profiles by withdrawing the necessity of a judge order and to include the maximum number of offenders with the purpose of preventing future crimes committed by these individuals.
