Potenciais aplicações da tecnologia Blockchain em contexto de Direitos de Propriedade Intelectual

Abstract

Nos últimos anos muito tem sido falado acerca da Quarta Revolução Industrial. Junto dela, surgem novas e disruptivas tecnologias, dentre as quais é possível encontrar a Blockchain. Esta tecnologia pode ser capaz de revolucionar diversos setores, sendo que o Direito não é alheio aos seus efeitos. O presente trabalho visa explorar as implicações da tecnologia Blockchain no contexto específico dos direitos de propriedade intelectual, considerando os seus desafios e oportunidades e, também, a problemática que impõem aos juristas e aos demais agentes envolvidos nas atividades latentes à exploração e proteção de direitos de propriedade intelectual. A Blockchain tem o potencial de revolucionar os sistemas tradicionais de gerenciamento de direitos de propriedade intelectual, oferecendo transparência, descentralização, desintermediação, segurança e imutabilidade. As soluções baseadas em Blockchain incluem o uso de contratos inteligentes (smart contracts) para automatizar o processo de registo e proteção de direitos autorais, marcas e patentes. No entanto, existem certos desafios a serem abordados para que a adoção dessa tecnologia seja bem-sucedida no ambiente dos direitos de propriedade intelectual, o que inclui a necessidade de padronização, interoperabilidade e da sua adoção generalizada, por exemplo. Dessa forma, o presente trabalho tem como objetivo avaliar os principais problemas relacionados com a gestão de direitos de propriedade intelectual e as soluções que a Blockchain poderá trazer nesse âmbito. Ainda, visa-se explorar os problemas criados pela utilização da Blockchain no ambiente dos direitos de propriedade intelectual, como é possível combatê-los e quais as dificuldades que deverão ser enfrentadas pelos juristas.

This technology has the potential to revolutionize various sectors, and the field of Law is not immune to its effects. This paper aims to explore the implications of Blockchain technology in the specific context of intellectual property rights, considering its challenges and opportunities, as well as the issues it poses for legal professionals and other stakeholders involved in the exploration and protection of intellectual property rights.Blockchain has the potential to revolutionize traditional systems of managing intellectual property rights by offering transparency, decentralization, disintermediation, security, and immutability. Blockchain-based solutions include the use of smart contracts to automate the process of registering and protecting copyrights, trademarks, and patents.However, there are certain challenges to be addressed for the successful adoption of this technology in the field of intellectual property rights, including the need for standardization, interoperability, and widespread adoption, for instance.Thus, this paper aims to assess the key issues related to the management of intellectual property rights and the solutions that Blockchain can bring in this context. Additionally, it seeks to explore the problems created by the use of Blockchain in the realm of intellectual property rights, how to address them, and the difficulties that legal professionals will need to overcome.
