CARITAS DEI: O amor cristão e a socialidade

Abstract

Sob uma realidade marcada por crises económicas, sociais, políticas, humanitárias, e, por última, sanitária, sem mencionar as de esteira ética, moral e cultural, exigisse-se da seara jurídico-política uma resposta normativa que, ao compreender os fenómenos que os chama, possa conformá-los dentro das expectativas da sociedade sem, contudo, desintegrar os arranjos jurídico-constitucional. A socialidade, não diferentemente, encontra-se (já algum tempo) arrodeada por riscos e questões que a coloca entre soluções que, por um lado, visa o máximo do seu esgotamento prático-conceitual, sendo-lhe atribuída, quase sempre, a culpa por um crescimento socioeconómico insatisfatório, causador de instabilidades políticas, e por outro, ao ignorar o cenário fático-que-se-impõe, defende-se a manutenção do seu arranjo jurídico-normativo status quo a mercê das ondulações históricas. Nesse cenário, em busca de compreender e elaborar uma resposta a essa problemática, resgatamos as origens da matriz cultural de Portugal, o cristianismo, para, a partir da sua dogmática e doutrina, traçar os valores fundantes da sociedade portuguesa que também os são, por desta integrar, do direto. Dessa forma, a presente dissertação, partindo-se da compreensão do amor cristão (caridade), e dos princípios e valores que dele derivam (ou nascem), como a dignidade da pessoa humana, a solidariedade e o agir social, voltado principalmente aos pobres, de todas as dimensões, demonstramos, com auxílio da doutrina social e do magistério católico, como ele, ao transpor o campo da moral-religiosa restrita a uma religião, impacta na seara público-política, reverberando-se no ordenamento jurídico-constitucional. Diante disso, em meio as correntes conimbricenses que versam sobre a compreensão e a disposição da jus-socialidade, inclinando-se para uma delas, e elegendo o amor cristão e suas im(a)plicações como farol e guia, propomos um desenho de socialidade em meio as crises, riscos e questões.

Under a reality marked by economic, social, political, humanitarian, and, lastly, health crises, not to mention those of ethical, moral, and cultural crises, a normative response is demanded from the legal-political field that, by understanding the phenomena that call them, can conform them within the expectations of society without, however, disintegrating the legal-constitutional arrangements. Sociality, not dissimilarly, is also beset by risks and questions that place it between solutions that, on the one hand, aim at the maximum of its practical-conceptual exhaustion, being attributed to it, almost always, the blame for an unsatisfactory socioeconomic growth causing political instabilities, and on the other hand, by ignoring the factual scenario that is imposed, the maintenance of its legal-normative status quo arrangement at the mercy of historical undulations is defended. In this scenario, in search of understanding and elaborating an answer to this problem, we rescue the origins of the cultural matrix of Portugal, Christianity, from its dogma and doctrine, and we trace the founding values of Portuguese society that are also of the law. In this way, this dissertation, starting from the understanding of Christian love (charity), and the principles and values that derive (or are born) from it, such as the dignity of the human person, solidarity, and social action, aimed mainly at the poor, of all dimensions. We demonstrate, with the help of social doctrine and the Catholic magisterium, how it, by transposing the field of moral-religious restricted to religion, impacts on the public-political sphere, reverberating in the legal-constitutional order. Therefore, between the Conimbrican currents that deal with the understanding and disposition of jus-sociality, leaning towards one of them, and choosing Christian love and its implications as a beacon and guide, we propose a design of sociality between crises, risks, and questions issues.
