Todavia, a regulação da rota entre diferentes países nessa região é realizada pela combinação entre dois sistemas legais - as Regras Uniformes CIM e o Acordo SMGS - cujas divergências prejudicam o avanço da atividade e aumentam as incertezas, o que impacta diretamente nos custos das mercadorias e serviços. Por esse motivo, discute-se o desenvolvimento de uma legislação comum para transporte ferroviário internacional de mercadoria entre Europa e Ásia, com o objetivo de uniformizar e unificar esses sistemas. Este trabalho analisa o atual panorama do transporte ferroviário, com foco no comércio entre Europa e Ásia, demonstrando suas vantagens econômicas e sua importância para integração internacional e para sustentabilidade ambiental. Na sequência, elenca as principais dificuldades que o transporte ferroviário tem enfrentado a nível de interoperabilidade legal e os principais problemas a nível contratual. Em seguida, estabelece que as diferenças entre os sistemas legais, especialmente no que se refere ao regime de responsabilidade, indenização e estabelecimento de direitos e obrigações nos contratos de transporte ferroviário, prejudicam o desenvolvimento das ferrovias no contexto internacional. Por fim, conclui ser imprescindível que os países e entidades privadas interessados cheguem a um denominador comum na criação de um instrumento que contenha soluções legais, inicialmente, harmônicas e, depois, unificadas, para que o escoamento de mercadorias do Pacífico ao Atlântico seja mais efetivo, mais rápido e, sobretudo, menos oneroso do ponto de vista econômico e ambiental. Rail transport is considered the most economic and sustainable transport mode. In this regard, railways are crucial for the commercial development, especially with the rise of commercial relations between Europe and Asia. However, the regulation of the route between different countries in this region is carried out by the combination of two legal systems – the CIM Uniform Rules and the SMGS Agreement – whose differences hinder the progress of the activity and increase uncertainties, which directly impact the costs of goods and services. For this reason, there is a discussion about the development of a common legislation for international rail freight transport between Europe and Asia, with the aim of standardizing and unifying these systems. This paper intends to provide an overview of rail transport, indicating its economic advantages, its importance for international integration and sustainability, focusing mostly on commercial relations between Europe and Asia. Moreover, this paper exposes the main issues regarding legal interoperability of railway transport and the issues arising of the transport agreement. The paper concludes that the differences between both legal systems, especially regarding liability, damages compensation and establishment of rights and obligations in railway transport agreements, deprive the development of this transport mode all over the world. In this regard, it is urgent the establishment of a minimum harmonization and, after this, the establishment of an uniformization of the railway transport law with appropriate standard rules for international railway transport in order to enable a more effective, faster and, most importantly, eco-friendly transport of goods from the Pacific to the Atlantic. |
