O Direito de Asilo na União Europeia e o Princípio da Não Discriminação: O Caso da Comunidade LGBTQ+

Abstract

Intitulada, O Direito de Asilo na União Europeia e o Princípio da Não Discriminação: O caso da Comunidade LGBTQ+, esta dissertação centra-se na possibilidade de se poder afirmar que existem dificuldades no respeito pelo Princípio da Não Discriminação, no seio da União Europeia, quando estão em causa pedidos de asilo da comunidade LGBTQ+. Para melhor compreendermos esta realidade, começamos por analisar o instituo de asilo. Primeiramente, no panorama internacional, veremos os documentos que permitem um entendimento mais amplo deste conceito, e aqueles que influenciaram o desenvolvimento do Sistema Europeu Comum de Asilo. Seguidamente, é analisada a rota do SECA, de forma a se conseguir entender como chegamos ao sistema que hoje conhecemos e como tramita um pedido de asilo na União, tendo como ponto fulcral os pedidos LGBTQ+. Após esta análise, estudaremos o Princípio da Não Discriminação, a sua importância no panorama legal europeu, nomeadamente, na política de asilo. Posto isto, é estudado o contexto de ainda vulnerabilidade da comunidade LGBTQ+, considerando os desafios que enfrentam na Europa e no Mundo.Munidos destes conhecimentos, passamos à análise da realidade dos requerentes de asilo LGBTQ+ na União Europeia. Entenderemos as diversas dificuldades que enfrentam durante a tramitação do pedido de asilo, desde os momentos de “prova”, à abordagem das entidades responsáveis pela análise do pedido, entre outras situações. Com o intuito de perceber se de alguma forma estes possuem caráter discriminatório. Abordaremos ainda, algumas propostas de soluções apresentadas para estas questões.

Entitled, The Right to Asylum in the European Union and the Principle of Non-discrimination: The case of the LGBTQ+ Community, this dissertation is based on the possibility of being able to state if there are difficulties in respecting the principle of non-discrimination, in the European Union, when asylum requests of the LGBTQ+ community are at stake.To better understand this reality, we will begin with the analyses of the asylum institution. First, in the international panorama, we will study documents that allow a broader understanding of this concept, and those that influenced the development of the Common European Asylum System. Then, to understand how it came to be the system we know today and how an asylum application is processed in the Union, with the LGBTQ+ requests as the focal point, we will study the CEAS path.After this analysis, we will study the Principle of Non-Discrimination. Its importance in the European legal panorama, namely, in the asylum policy. Hereupon, the vulnerable context of the LGBTQ+ community is studied, considering the challenges they face in Europe and in the World.Furthermore, we will proceed to the analyze of the reality of LGBTQ+ asylum seekers in the European Union. We will understand the numerus difficulties they face during the process of the asylum application, from the moments of “prove”, to the approach of the entities responsible for the application analyses, among other situations, and if these, are in some way, discriminatory. We will also discuss some proposed solutions for the considered issues.
