Estudo de uma ferramenta de notificação de maus-tratos em crianças e adolescentes

Abstract

A violência física em crianças e adolescentes é uma questão de Saúde Pública Global. Este trabalho pretende identificar as lesões traumáticas e o enquadramento médico-legal da condição da vítima, através do estudo e análise estatística dos dados de uma ferramenta de notificação, e também entender a denúncia da suspeita de violência em crianças, face à regulação da proteção de dados em vigor em Portugal como Estado da União Europeia.O estudo desenvolveu-se em duas etapas: 1) análise da regulação e proteção dos dados pessoais e 2) elaboração, proposta e análise de uma ferramenta de notificação de violência física contra crianças e adolescentes. A primeira compreendeu a realização de uma scoping review. Após a aplicação dos critérios de inclusão e de exclusão, foram obtidos um artigo científico e cinco relatórios de websites e organizações. A segunda etapa compreendeu a elaboração e ajuste de uma ferramenta de notificação através da realização de um estudo coorte observacional e retrospetivo na base de dados do Centro Académico Clínico de Coimbra e respetiva análise estatística através de testes não paramétricos.Obteve-se uma ferramenta de notificação para uso de profissionais de saúde oral e respetivo guia de preenchimento e foi efetuada a análise descritiva das variáveis ¬— sexo, idade, zona de residência, ligação do agressor à vítima, número de agressores, local de ocorrência, etiologia das lesões, lesões orofaciais, lesões não orofaciais, Quantum doloris, tempo de incapacidade temporária, e afetação funcional e estética das lesões — e respetivas relações. Destacou-se que o Regulamento Geral de Proteção de Dados atua, não como uma barreira ao tratamento e partilha de dados justificados, mas como um enquadramento na salvaguarda dos Direitos fundamentais do individuo, incluindo o Direito à Saúde. No grupo etário dos 0-12anos, os progenitores foram os principais perpetradores da violência, com destaque para a residência como local de ocorrência. No grupo etário dos 13-16anos, a violência surgiu maioritariamente na escola, salientando um tipo particular de crime, o bullying, perpetrado pelos colegas.O papel do médico dentista é destacado pela grande incidência de lesões orofaciais e deve o seu exame, incidir não apenas sobre a região orofacial, devido à complexidade do quadro lesional. A ferramenta proposta permitirá a identificação e organização meticulosa da informação dos diversos intervenientes no evento traumático, a análise da imputabilidade do crime, bem como a avaliação dos danos pessoais decorrentes, e destacará a intervenção do médico dentista na diminuição da violência física contra crianças e adolescentes.

Physical violence against children and adolescents is an issue of Global Public Health. This paper aims to identify traumatic injuries and the medical-legal framework of the victim’s condition through the study and statistical analysis of data of a reporting tool, while understanding the reporting of suspected violence against children, in view of the data protection regulation in Portugal, as a member state of the European Union.This study developed itself in two tasks: 1) analysis of personal data protection regulation and 2) development, proposal, and analysis of a reporting tool of physical violence against children and adolescents. The first comprised a scoping review. after applying the inclusion and exclusion criteria, an article and five reports from websites and organizations were selected. The second stage comprised the elaboration and adjustments of a reporting tool through a retrospective and observational cohort study in the Clinical Academic Center of Coimbra’s database and the statistical analysis through non-parametric tests.The reporting tool and the respective filling guide were obtained for use by oral health professionals and a descriptive analysis of the variables was carried out - sex, age, area of residence, connection of the aggressor to the victim, number of aggressors, place of occurrence, etiology of injuries, orofacial injuries, non-orofacial injuries, Quantum doloris, time of temporary disability, and functional and aesthetic affectation of the injuries- and their relationships.It was highlighted that the General Data Protection Regulation is not a barrier to the treatment and sharing of justified data but a framework for safeguarding the individual's fundamental rights, including the Right to Health.In the 0-12 age group, parents were the foremost perpetrators of violence, emphasizing the residence as the place of occurrence. In the 13-16 age group, violence mainly appeared at school, highlighting a particular type of crime, bullying, perpetrated by peers.The high incidence of orofacial injuries highlights the role of the dentist. Their action should focus only on the orofacial region due to the complexity of the injury pattern.The proposed tool will allow the identification and meticulous organization of the information of the different actors in the traumatic event, the analysis of the imputability of the crime, as well as the evaluation of the personal damages, and it emphasizes the dentist's intervention in reducing physical violence against children and adolescents.
