Pornografia de Menores e Agente Encoberto em Ambiente Digital

Abstract

A exploração sexual é uma das formas mais graves de violência cometida contra crianças, incluindo a Pornografia de Menores como manifestação de violência contra estas. Ao longo dos anos, as TIC têm sido objeto de muita evolução, sendo cada vez mais utilizadas pela sociedade no dia-a-dia, como por exemplo, em compras online, marcação de atendimento nos serviços públicos, e até aprendizagem, tal como vimos ao longo do tempo de pandemia e até aos dias de hoje (evolução na aprendizagem), plataformas de desporto, entre muitas outras atividades que se podem fazer através destas tecnologias. Mas, com esta evolução tem vindo a surgir uma série de malefícios para os utilizadores, como por exemplo, o maior e mais fácil acesso a meios de divulgação e produção de conteúdos pornográficos.O desenvolvimento e gravidade deste tipo de crime merece o nosso foco e atenção, uma vez que, existem dificuldades inerentes à aquisição de prova, por ser uma prova de fácil dispersão, caracterizando-se pela volatilidade, instabilidade, diversidade de tecnologias utilizadas e o anonimato oferecido pelas TIC aos agentes deste tipo de violência. Acresce ainda, a análise de grandes quantidades de informação, o que leva a extrema dificuldade na identificação de vítimas e agressores.Outra dificuldade relacionada com o objetivo do Agente Encoberto, é saber se terá sido apenas encoberto para a prevenção e apoio à Investigação Criminal, ou se terá sido também ele Agente Provocador daquele crime. Assim, o objetivo desta dissertação incide sobretudo no estudo da utilização da figura jurídica do Agente Encoberto, como método oculto de meio de obtenção de prova, em contexto do crime de Pornografia de Menores em ambiente informático, e na grande importância destes agentes para a prevenção de crimes desta natureza. Neste texto, procura-se estudar o Agente Encoberto como forma de prevenção do crime em causa, através da infiltração virtual do mesmo. Acreditamos que através desta figura, se consegue prevenir e levar ao insucesso crimes desta natureza, atuando no momento em que o agente da prática do facto ilícito esteja a aliciar menores, conseguindo assim, nesse momento, obter-se conteúdos e informações, por forma a realizar-se uma possível interceção do mesmo, de modo mais eficaz e célere.

Sexual exploration is one of the most serious forms of violence committed against children, including pornography as a manifestation of violence against them.Over the years, ICT has been the subject of much evolution, being increasingly used by society in daily life, such a shopping online, booking of care in public services, and even learning, as we have seen over the time of the pandemic and to we continue to see (evolution in learning), sports platforms, among many other activities that can be done through these technologies. But with this evolution has been emerging a number of harms for users, such as greater and easier access to means of dissemination and production of pornographic content.The development and severity of this type of crime deserves our focus and attention, since there are difficulties inherent to the acquisition of evidence, because it is a proof of easy dispersion, characterized by volatility, instability, diversity of technologies used, and the anonymity offered by ICT to agents of this type of violence. In addition, the analysis of large amounts of information, which leads to extreme difficulty in identifying victims and aggressors.Another difficulty related to the objective of the undercover agent, is whether he was only covered up for the prevention and support of the Criminal Investigation, or if he was also the Covert Agent of that crime.Thus, the objective of this dissertation focus mainly on the study of the use of the legal figure of Covert Agents, as a hidden method of means of obtaining evidence, in the context of the crime of Pornography of Minors in a computer environment, and on the great importance of these agents for the prevention of crimes of this nature.In this text, we seek to study the Undercover Agent as a way of preventing the crime in question, through the virtual infiltration of the same. We believe that through this figure, crimes of this nature can be prevented and brought to failure, acting at the moment when the agent of the practice of the unlawful fact is enticing minors, thus obtaining content and information, in order to make a possible interception of the same, more effectively and quickly.
